The Curious Case of the Senate Education Committee

I haven’t written about the Legislature’s newly reconstituted committees because there’s been a lot of other stuff going on. But there’s one committee that really caught my eye, and that’s the Senate Education Committee. Since education funding and structure are likely to be the dominant (and most contentious) issues in the new session, this panel will play a key role.

The Senate’s Committee on Committees chose to split the panel right down the middle — three Democrats and three Republicans. It’s pretty unusual. for the majority party to voluntarily relinquish its customary right to occupy most of the seats. Senate President Pro Tem Phil Baruth said the intention was to create a committee that would “put out bipartisan bills.”

Sounds noble. It also puts the Republicans on the spot. They can’t just sit back and vote “No” on Democratic proposals. If they don’t come to the table and negotiate, then nothing will get done.

Still, the Democrats are ceding power when they didn’t have to. Usually, a policy committee would craft bills favoring the majority’s agenda and then see the bills get watered down as they meander through the legislative process. In this case, the compromising will begin immediately. But that’s not what’s bothering me the most about the education panel.

All in All, Not a Bad Speech

At the end of my previous post, I looked ahead to Gov. Phil Scott’s inaugural address (which I mistakenly dubbed “State of the State,” sorry) with these words: “We’ll see how much actual ‘coming to the table’ he does, and how much kicking the Legislature he indulges in.”

And now we know. The governor was sworn in and delivered his speech on Thursday afternoon. There was some definite kicking, to be sure. There was also a broad outline of an agenda that emphasized his usual talking points. But the final section of the speech was pure uplift. After ticking off the challenges we face, Scott listed some positive accomplishments not directly tied to anything partisan.

The first one, in fact, was a barely concealed slap at his fellow Republican, Donald Trump. “We’ve received over 1,000 refugees in the last three years and will continue,” Scott said, prompting one of two standing ovations that brought the entire chamber to its feet. (“Entire” as best I could tell watching the livestream, that is.)

His point was that Vermonters can tackle challenges and get hard things done. I may not completely share that optimism, but it was a positive, collaborative message.

At least for today it was. Scott’s budget address two weeks from now will contain the details of his 2025 agenda, and you know where the devil is.

Jim Douglas Manfully Bears the White Man’s Burden

I came onto the scene a bit too late to get the full Jim Douglas Experience. Moved to Vermont in 2006 (which, yes, still a flatlander, I know, should I really be allowed to vote?) and didn’t pay much attention to #vtpoli until the 2010 campaign, when Dead-Eyed Jim was on his way out the door and into a fairly inert retirement. I have to admit, I see photos of this guy with his characteristically vacant non-smile, and I just don’t get the appeal. Like, this picture on the cover of his terrible memoir (see below), presumably chosen or approved by the subject, makes him look like he’s contemplating a bit of cannibalism.

But I will say this. If Douglas wanted to find a cause celebre to occupy his Golden Years, it’d be tough to find anything more apropros than defending the good name of a long-dead governor from the merry days of Kipling-style white supremacy. If any modern-day figure seems made to carry the threadbare mantle of those unenlightened times, it’s Jim Douglas. And here he is, spending years and clogging up the courts in his defense of former governor John Mead, whose most infamous contribution to our civic life was his enthusiastic advocacy for eugenics.

Douglas took one for the team last week when a judge issued a decidedly unfriendly ruling in his lawsuit over Middlebury College’s decision to take Mead’s name off the college chapel, the most prominent building on campus. It’s one of those rare stories in our perilous times that made me chuckle over my corn flakes.

The Scott Administration Would Very Much Like to Convince You That It Cares About Education

I remember a moment, long ago in a much simpler time, when the Shumlin administration came under scrutiny for hiring communications staffers for multiple state agencies. In fact, hey, here’s the story from Seven Days way back in 2012, reporting that while candidate Peter Shumlin had vowed to cut communications people from state agencies, his administration eventually tried to hire even more of ’em.

Well, now we have a job listing from Gov. Phil Scott’s Agency of Education seeking a “Director of Policy, Strategy, and Communications” at an hourly rate of $40.83, which amounts to an annual salary in the $80,000 range.

Okay, so the idea that comms people are a luxury seems kind of quaint nowadays. But wait, there’s more!

The Director, according to the job description, “will oversee a team of three digital communications and policy specialists.”

Yep, that’s right. The Education Agency doesn’t just need a flack. It needs a gaggle of flacks to handle both external and internal communications. This “team” would not only handle the press, legislative relations and interagency communications — it would also serve as a middleman between AOE leadership and its own people.

Our Political Betters Are Strangling Vermont State University

A tremendous piece of reporting by VTDigger’s Theo Wells-Spackman lays out the dire situation facing Vermont State University and, although it sticks to the cautious, both-sides nature of modern journalism, it pretty much points the finger at the real culprits: Gov. Phil Scott and the Legislature.

It’s not a pretty picture. Falling admissions, leadership turmoil, cutbacks across the board, more cuts coming down the pike, half-empty (or worse) campuses, morale in the toilet. In short, something that looks just like a death spiral. And barring a sudden influx of resources from a state that has always shortchanged higher education, it’s hard to see how VSU pulls out of it. I’m sure it will survive in some form, but there’s no way it can become the robust, lower-cost, in-state alternative to the University of Vermont that we need it to be.

The situation would be bad enough, but the real killer is the state’s insistence that VSU maintain operations at all five of its campuses while implementing a painful series of state-mandated budget cuts.

Penny for Your Thoughts, Madam Secretary

I only have one question about two state senators filing a lawsuit over the appointment of Zoie Saunders as interim education secretary after her nomination for the permanent job was rejected by the Senate.

Why only two senators?

Well, I do have another question: What must Saunders be thinking? If I were to guess, it’d be something along the lines of “How did I get myself into this?”

She quit a job she’d barely started in an area that had been her home for years and moved her family a thousand miles north, just to be used as a political shield by the Scott administration and see her reputation dragged over the coals. And this legal challenge could prevent her from serving at all.

My sympathy is limited because she’s a grown-up who made her own choices and she freely accepted a job that she’s unqualified for, but there is a human being in the middle of this uncomfortable mess.

Now, back to the first question: Why did only two senators sign onto the lawsuit?

Phil Phones It In

For weeks, Gov. Phil Scott has been asking legislative leadership to “come to the table” and reach common ground on the school funding situation. On Wednesday, they came to the table — and the governor was nowhere to be found. He stiffed ’em.

He stiffed ’em physically by not showing up, and he stiffed ’em intellectually by presenting yet another half-baked, fiscally irresponsible “plan” for buying down property tax rates.

To me, his no-show proves that he didn’t want a deal that might be politically difficult. He’d prefer that the Legislature override his veto of the Yield Bill so he can use it as a campaign issue in hopes of eroding the Dem/Prog supermajorities.

Look, if he wanted a deal, he would have been there. If there was going to be a serious effort at compromise, he would have had to be there. His officials couldn’t have conducted meaningful negotiations in his absence.

It Was Supposed to Be an Emergency Drill for Students, But Now It’s the Adults Who Are Ducking and Covering

Far be it for me to imply that the Burlington Police Department doesn’t know what the hell it’s doing, but in this case they clearly didn’t.

The BPD is in hot water, possibly to be joined in the pot by the Burlington Public Schools and Mayor Emma Mulvaney-Stanak, whose recent reappointment of Police Chief Jon Murad, over the objections of her fellow Progressives, now seems like maybe not such a great idea.

On Wednesday, a group of 20 Burlington High School students were on a field trip to One North Avenue when screams rang out and two women ran into the room, pursued by a masked gunman. Who opened fire.

It was a drill staged by the BPD with the apparent goal of scaring the shit out of the kids and maybe giving them PTSD. “I’m shaking and crying because I’m like, Oh my god, I’m gonna get shot,” one student told Seven Days. “It felt so real.”

In an utterly inadequate press release blandly (misleadingly) entitled “BHS Scenario Response,” the BPD called this a “roll- playing scenario” (sic) that “was not directed at any students or faculty.”

Pardon me, but what the actual fuck? The masked gunman was in the room with the school group and gunshots rang out. How in hell were they supposed to know that it “was not directed” at them?

Turn On the Light and Yep, Cockroaches

Alison Novak, Seven Days’ education reporter and one of the brightest lights in Vermont journalism, has produced another scoop worthy of your attention. She reports that identical “Just Say No” signs have appeared in at least three Chittenden County communities where school budgets were up for vote: Essex, Milton, and South Burlington. The signs bear the imprimatur, in teeny-tiny print, of “CCGOP,” a.k.a. the Chittenden County Republican Committee.

It’s not illegal for an outside political group to try to influence local school votes, but it’s highly unusual. The CCGOP’s reaction to Novak’s inquiry was telling; some ducked and covered, while others offered what the reporter called “confusing — and sometimes conflicting — accounts,” as if they’d gotten caught with hands in the cookie jar. In fact, Milton’s own Republican Rep. Chris Taylor said he was “dismayed” by the signs, and found them “counterproductive” to civil discourse around the budget.

And when you take a closer look at the parties involved, well, let’s just say some familiar faces were on the list.

Governor No Prepares to Strike Again — UPDATED With More Potential Vetoes, Yay

The Vermont Legislature just wrapped up a fairly productive session, all told. Or should I say it will have been productive if Gov. Phil Scott doesn’t whip out the ol’ veto pen (Only in Journalism) and kill a whole bunch of bills.

And by all indications, that’s exactly what he’s about to do.

Might I take a moment to say, once again, that any Democrat who votes for Phil Scott isn’t serious about the Democratic agenda? Because the Legislature will have all it can do to override a couple, maybe three, gubernatorial vetoes. Even when you’ve got a supermajority, overrides are tough. So as long as Scott is governor, the Democratic vision for Vermont will remain frustratingly (or, if you don’t like Democratic policies, hearteningly) incomplete. Especially when it comes to climate change, where the governor is in position to decimate what the Legislature has accomplished.

There’s already been one veto this year, on the flavored tobacco ban. Override failed on a close vote in the Senate. By my unofficial and possibly incomplete count, we are probably in for six more. At least. Here’s the list.
