The Wide, Wide, Almost Infinitely Wide World of Lobbying

Once in a while, some media outlet will publish a formulaic piece about Statehouse lobbying. It happens when lobbyists and clients are required to report their spending with the Secretary of State’s office. A reporter will pore over the filings, point out the highest-grossing lobbying firms and some big-dollar clients, and get both-sides quotes from (a) those concerned with lobbyist influence and (b) those (mostly lobbyists) who think it’s not a big deal. And that’s it.

Last week, I started looking at the finance reports from the latest deadline, March 15, with an eye toward writing such a roundup. But the more I read, the more I realized that I didn’t know. After spending several days on the subject, I’ve concluded that the actual world of lobbying in Montpelier is just about unknowable. Those finance reports represent one sector of lobbying activity, and probably a small one at that.

Let’s start with a quick quiz. How many individuals are registered as lobbyists with the Vermont Secretary of State?

Six hundred and four.

Now, if all those people were roaming the Statehouse on the same day, it’d be like that episode of Star Trek with the overpopulated planet that needed Captain Kirk’s germs (transmissible only by a kiss with a beautiful blond) to thin the crowds. Most lobbyists aren’t there every day. Some of them are rarely, or never, there. But that’s the size of the universe we’re talking about.

Mailed Ballots: A Study in Legislative Timidity

A couple of weeks ago, the Senate Government Operations Committee approved S.15, a bill that would mandate mail-in ballots for November elections. On Wednesday, the panel was presented with an opportunity to make the mandate universal, applying to general elections, primaries, and Town Meeting Day.

(The only exception: Communities that hold actual town meetings would be exempt. Towns that use the Australian ballot for TMD questions would have to provide mail service to all voters.)

And the committee couldn’t back away fast enough. Members used every delaying tactic in the book, from straw-man punching to red herrings to gross exaggeration. It was so sad that the panel even balked at the last refuge of legislative delay, appointing a study committee!

Now, there was a bit of political gamesmanship involved on the part of Republican Sen. Corey Parent, who offered the amendment to S.15. If he was completely serious about the idea, he could have proposed it sooner. The deadline for policy bills to pass the Senate is this Friday, and it’s a stretch to think his amendment could get due consideration in Gov Ops and on the Senate floor.

But he did have a serious point, and I have to say I agree with him.

The case for wind

Most of Vermont’s media coverage of wind energy tells a David-and-Goliath story: the plucky locals and underdog activists going up against a corporate developer and the state regulatory system.

The pro-wind case usually gets short shrift. But even when it gets equal time, it’s almost always in response to anti-wind arguments. Rarely, if ever, is the positive case for wind given a fair hearing. As a result, there’s quite a bit of stuff about large-scale wind that most Vermonters don’t know. Here’s a list, with details to follow.

— For all our bluster about fossil fuels and gas pipelines, Vermont remains heavily dependent on fossil fuels, including fracked gas.

— Wind is a necessary component of a renewable system. There is no way we can reach our “90 percent by 2050” goal without large-scale wind.

— Wind has huge economic benefits, including tax payments to local and state governments and a healthier trade balance.

— Large-scale wind cannot be replaced by residential  turbines. It just doesn’t work. And replacing large-scale wind with more solar would dramatically increase solar’s footprint on our landscape.

— Thanks to recent advances, large-scale wind no longer has to be sited on the highest mountaintops. Lower ridges and hills are now suitable sites.

— Siting on developed land and rooftops is good, but it’s only a fraction of what we need. There aren’t nearly enough developed sites and roofs in Vermont.

VTDigger’s at it again

I was hoping maybe my recent post, “VTDigger is Biased Against Wind Energy,” would at least make the folks on the second floor stop and think.

I guess not. Because they’ve got another doozy today, entitled “Bird Advocates Concerned About Stiles Brook Proposal.”

The gist of the article is that an organization called the American Bird Conservancy has weighed in on the proposed Grafton/Windham wind farm with dire warnings about rising piles of bird and bat corpses.

“ABC questions whether the sacrifice of hundreds of thousands, if not millions, of our shared ecologically important birds and bats justifies building any large, commercial wind energy facility in areas with seasonally high concentrations of birds and bats, like (Stiles Brook),” wrote Michael Hutchins, director of the conservancy’s “Bird Smart Wind Energy Campaign.”

Okay, hmm. “Hundreds of thousands, if not millions” from a single wind farm? Sounds awful.

Too bad it’s completely false.

VTDigger is biased against wind energy

Or so it would seem. Recent articles have been clearly slanted in presentation and sourcing. I’ve been hoping this would get better, but a story posted late Wednesday was the straw that broke my back.

It’s entitled “Searsburg Residents Gird for Wind Project Blasting,” which makes it sound like widespread panic over the potential devastation of a peaceful town. The particulars below; first, let’s outline the general pattern at work in Digger’s coverage.

It starts with the David-and-Goliath framing: aggrieved locals versus a big faceless developer. The locals are represented by a single complainer or, in the case of a continuing story, the same handful of folks. The vast majority of local residents who either favor a development or don’t much care are absent.

Never or rarely mentioned is the fact that a wind farm is a literal windfall for a town’s treasury, greatly reducing residents’ tax burdens and underwriting new programs and amenities. (With all our concern about Growing the Economy and Reducing the Tax Burden, you’d think that would be a compelling argument.)

An then there’s the extreme imbalance of outsiders. The same couple of anti-wind advocacy groups are routinely cited, while the numerous environmental groups that support wind energy are rarely if ever represented. A call always goes out to Energize Vermont or Vermonters for a Clean Environment; why not VPIRG or Vermont Conservation Voters or Wind Works Vermont or the Sierra Club or VNRC or The Nature Conservancy?

Finally, there’s space allotment. Within a story, opponents are given far more space than its supporters. Their arguments are quoted at length; supporters are allowed a token response.

That’s the pattern. Now for some examples in detail.

VPIRG still serious about carbon tax

Interesting hire by VPIRG. They’ve signed on businessman and veteran Democrat Tom Hughes as Campaign Manager of Energy Independent Vermont. EIV, for those just tuning in, is a coalition of businesses, nonprofits, academics, and advocates with the goal of addressing climate change and as VPIRG puts it, “grow[ing] the economy by putting a price on carbon pollution.”

Also known as the carbon tax. Well, not exactly, but more on that later.

The hiring of Hughes is a little unusual, in that advocacy organizations like VPIRG usually fill their staffs with energetic and (ahem) cheap young people. Hughes has been around for a while. “Our partners and our financial resources allowed us to bring in a really seasoned person,” said VPIRG chief Paul Burns.

Hughes was a top Democratic activist in the late 90s and early Aughts. He served a shift as VDP Executive Director and held the same post for Howard Dean’s Democracy for America, he was a staffer in five presidential campaigns, and managed Doug Racine’s gubernatorial campaign in 2002.

He’s spent the past several years in the business world, as a division president of Country Home Products and co-founder of a renewable energy firm. Burns cites the combination of political and business experience as key in the EIV campaign. “Tom has a stellar reputation,” he said. “He’s not a partisan hack. He’s distinguished himself as someone who can run campaigns and be effective in the business world.”

Speaking of the carbon tax, despite the scare-mongering of Vermont Republicans and the timid response from leading Democrats, EIV will actively promote a carbon tax in the 2016 legislative session. Not that they expect to prevail: “I won’t predict that a bill will pass the Legislature and land on the Governor’s desk in 2016,” said Burns. “But we’re making progress each day toward our goal.”

Still, “2016 is a really important year to move the conversation forward. The challenges are really great for passing [the carbon tax], but there’s an awful lot of progress we can make and a lot of conversations we need to have.”

Climate incoherence, stage right

Very sorry to have missed Thursday’s carbon tax debate, featuring the Good Guys (Paul Burns of VPIRG and UVM’s Jon Erickson) against the Death Star Duo, Rob Roper and John McClaughry of the Ethan Allen Institute.

Oh yes, fair and balanced shall I be.

I’m sure the DSD walked away believing they’d won, because they are dyed-in-the-wool true believers whose outlook is hermetically sealed against the intrusion of actual evidence. Also, lest we forget, they’ve received hundreds of thousands of dollars from out-of-state conservative donors with ties to the Koch brothers.

The really striking thing about their presentation was the difference between Messrs. McClaughry and Roper. McClaughry is an out-and-out denier. Roper acknowledges climate change but says there’s nothing we can do about it, so we shouldn’t even try.

Yeesh.

Learn To Play Dog Whistle the Phil Scott Way!

Now that Phil Scott is officially a candidate for governor, he’s stepping up his attacks on Democratic policies. But he’s doing it in an oblique way: he doesn’t name names, he isn’t abusive; he isn’t angry, he’s simply “concerned.”

But the intent is obvious. Take, for example, a one-paragraph press release issued by The Office of Lieutenant Governor Phil Scott “in response to a Nov. 30 press event held by the Vermont Public Interest Group (VPIRG) showing support for a carbon tax.”

“Vermont is already setting a national example for green building practices, energy conservation, renewable energy and environmental stewardship. I believe we need to balance our environmental leadership with the economic priorities we have for Vermont. Since the carbon tax has been proposed, I’ve heard from many Vermonters who strongly oppose higher cost gasoline and home heating fuels, and understand how this proposal would increase the cost of living across the board. It is clear to me that the vast majority of Vermonters want the Legislature to spend its time looking for ways to grow the economy and save working Vermonters money. Discussion of a new tax that could add as much as 88-cents to a gallon of gasoline is not a way to grow the economy or save money – therefore I oppose this tax.”

That paragraph, like many of his positions, starts with a smiley face but ends with a harsh takedown. It all adds up to “We’ve done enough on the environment. Don’t expect anything more.”

This velvet glove/iron fist approach ripples throughout the speech he delivered (not very well) at his campaign launch. He started with a humblebrag about his ability to “bring people together, achieve consensus and bridge growing partisan divides.”

And then he proceeded to hammer the Democrats over and over again.

Climate change follies

You’ve got to hand it to David Sunderland, chair of the VTGOP. When he gets hold of a notion, he just doesn’t let go. No matter how stupid the notion may be.

Today’s exhibit: Not content with a series of inflammatory press releases against the carbon tax, which is not on the Legislature’s agenda, nor will it be anytime soon, Sunderland has launched a new website aimed specifically at the carbon tax. Which is not on the agenda, nor will it be anytime soon.

But brave Dave won’t let the facts get in his way on this, any more than the scientific consensus on climate change has penetrated his brain. The website depicts a doomsday scenario for Vermont, and the Demcrats as the evil villains plotting the state’s demise.

Well, as Hillary Clinton told one of the House Benghazi Committee bozos, “I’m sorry that it doesn’t fit your narrative. I can only tell you what the facts were.”

Old dog, old trick

Unsurprisingly, VTGOP chair David Sunderland has rejected VPIRG head Paul Burns’ invitation to a public debate on the idea of a carbon tax. I’m sure that Burns would press him, not only on that issue, but on where Sunderland stands on climate change. After all, his only public statement on climate change was a denialist claim that there’s “science on both sides.”

No, Dave. There’s the scientific community on one side, and a handful of tame “experts” on the fossil fuel industry payroll plus a few cranks operating outside of their core competency. Recent revelations about ExxonMobil make this even more clear: nearly four decades ago, the oil giant’s own scientists concluded that climate change was real and caused by human activity.

Well, instead of debating a very knowledgeable person who heads an organization which supports a carbon tax, Sunderland has seized the opportunity to renew a pointless call for a debate with Dottie Deans, his Democratic counterpart. His wafer-thin rationale: the carbon tax is “sponsored by over two dozen Democrat legislators,” hence it must be a Democratic — pardon, “Democrat” — idea, hence Ms. Deans is responsible for defending it.

Yeah, well, nuts. Unless the carbon tax is in the Democrats’ platform, Deans is not answerable for it.
