A Bunch of Bad News for the Bennington Battle Monument — And the State’s Troubled VTBuys System

A story published a few days ago by VTDigger sparked my curiosity about the status of the extremely phallic Bennington Battle Monument, which I have dubbed Vermont’s “Gilded Age tribute to toxic masculinity.” When last I wrote about this “ponderous pecker,” news had come out that the thing was made of highly absorbent limestone that had, of course, become waterlogged. Repairs were estimated at about $40 million, to which I responded that we ought to just blow the damn thing up.

The latest Digger piece reported that the state is about to hold two public meetings to discuss what to do with the Monument. What it didn’t report is that the $40 million figure is nothing more than a semi-educated guess. Nobody knows how much it would really cost, or the price tag for ongoing maintenance if we do fix it up. That’s partly because the state lacks critical data, thanks to the deeply troubled VTBuys contracting and payment portal — yet another demerit in Gov. Phil Scott’s ineffectual efforts to reinvent state government.

We take you back to February 10, and a hearing of the House Corrections & Institutions Committee that went completely uncovered by the sleepy watchdogs of our news media. I came across it as I poked around for more information about Digger’s latest story. But anyone with an interest in the Monument, or in the orderly function of state government, needs to know what went on that day.

Come to the Table, Talk to the Hand

At his Wednesday press conference, Gov. Phil Scott was studiously noncommittal on the use of state prisons to house federal detainees. He unironically expressed the belief that it might be better for detainees like Mohsen Mahdavi to be kept in Vermont instead of being dragged off to Mississippi (where Vermont routinely sends its own inmates) or some other hellhole. But he left the door open to working with lawmakers on that issue and others, as the Legislature considers ways to manage state cooperation with federal immigration authorities.

Behind the scenes, something very different is happening. The Scott administration appears to be stonewalling a legislative panel with jurisdiction over the prison contract.

This comes from Independent Rep. Troy Headrick, a member of the House Corrections & Institutions Committee, with additional input from fellow committee member, Democratic Rep. Conor Casey.

Headrick wrote a blogpost on April 16 detailing “executive obstruction” frustrating the committee’s work on the issue. “In committee, we have developed a tri-partisan consensus,” Headrick writes, “that Vermont has no business being complicit with [Immigration and Customs Enforcement]’s repeated violations of due process, the First Amendment, and basic human rights.”

Unfortunately, he continues, this effort to end the feds’ use of state prisons to hold detainees has been “stalled… by direct interference from the Governor’s office.”

Hang On, Female Inmates, We’ll Get You a New Prison In Maybe Less Than a Decade

This charming space, with its comfy chairs and natural lighting and complete absence of books, is either a prospective rendering of Vermont State University’s new “library” or a possible concept for a new women’s prison in Vermont.

Spoiler alert: it’s the latter. On Thursday morning, the House Corrections & Institutions Committee took the next small step toward building a new facility to replace the inadequate and unsanitary mess that is the Chittenden Regional Correctional Facility, a.k.a. Vermont’s women’s prison.

I say “small step” because, as the hearing revealed, it’s going to take — maybe — five to eight years to complete the process of designing, siting, and building a new facility. Or possibly longer. There could be roadblocks, and everything is dependent on a solid funding commitment. I’m sure the inmates can be patient about this.

The hearing centered on a presentation by HOK, an architectural firm that’s best known for building sports stadiums but has also designed more than $4 billion in what it euphemistically calls “justice facilities.” HOK’s Justice Division, so they say, “focuses on designs for human rights and a more just world as a whole.” By building prisons. (It received $1.5 million from the state for doing the research that led to Thursday’s presentation, which can be downloaded from the committee’s website.)

In the first phase of its study, commissioned in 2020, HOK unreservedly recommended closure of CRCF and replacement with a new facility. The state is committed to do so, but that’s about as far as it’s gotten. Veteran C&I Chair Alice Emmons said this year’s work will focus on finding a location for the new facility. “You don’t do nothin’ without land,” she said. The 2024 session will focus on moving from the concept-idea stage toward an architectural design. After that comes project bidding and selection, construction, and making the transition from CRCF to the new place.

There was no attempt to determine how large the new facility should be, but there was plenty of discussion on the subject that broke down into two camps: We’ve got to build it as big as it might possibly need to be, or we can take a less maximalist approach because we’ll continue on the path of justice reform because incarcerating large numbers of people is fundamentally inhumane and counterproductive.
