Vermont’s Campaign Finance System Is Useless, And That’s a Product of Deliberate Design

Secretary of State Sarah Copeland Hanzas gave it the old college try. This year, after every campaign finance reporting deadline, she published lists of all candidates who failed to file as required by law. This was aimed at encouraging compliance, if only by the embarrassment of being publicly identified as a scofflaw.

It was a good idea, but it didn’t work. The proof? The most recent list of non-compliers, released after the December 15 deadline for Final Reports, was by far the longest of all the lists. Proof that avoidance of embarrassment meant nothing whatsoever to candidates for public office.

The list is actually three lists: Those who filed, those who filed an “Under Threshold” report (didn’t raise or spend $500 or more), and those who just let the deadline fly by. And yes, if your campaign had no reportable activity, you’re still required to officially attest to that fact.

Among statewide candidates, only two are in the failed-to-file category: Republican candidate for treasurer (and Republican National Commitee member) Joshua Bechhoefer and, um, incumbent Auditor Doug Hoffer. Oopsie.

It gets really embarrassing when you get to legislative candidates. The list of Senate scofflaws is almost as long as the list of those who complied. A total of 30 Senate candidates, including seven winners, did not file a Final Report. In the House, 105 candidates failed to file, including (by my count) 32 winners.

An Especially Unsettling Spin of a Familiar Revolving Door

There’s nothing illegal about this. It happens all the time. But this particular instance has a bit of a stench about it.

I’m talking about Sarah Mearhoff’s departure from VTDigger. Mearhoff has been the Statehouse bureau chief for Digger, the lead author of its “Daily Briefing” newsletter and its top political reporter throughout this campaign season. She announced her departure last Friday on the accursed platform once known as Twitter. She did not reveal her next professional destination.

But now we know. Mearhoff is crossing over to the dark side. She’s been hired as director of advocacy and communications for the Associated General Contractors of Vermont.

Chief lobbyist, in other words. For one of the most powerful and connected interest groups in Montpelier. Until December 14, Mearhoff was reporting on the doings of our representatives under the Dome. In less than three weeks, she’ll be trying to influence those same people on behalf of Vermont’s road builders and construction magnates, a.k.a. Phil Scott’s favorite people in the whole world.

We Are Unsheltering You For Your Own Good

I circled back to Gov. Phil Scott’s November 13 press conference because I was interested in the coverage of his comments about our burnt orange president-elect. VTDigger reported that Scott was urging people to give Donald Trump a chance:

“For the sake of our country, we need to tamp down the division and fear, and we need to at least give him the opportunity to do better and do the right thing.”

It sounded like the pundit class’ evergreen hopes that any minute now, Trump was about to start acting presidential. But when I listened to Scott’s full remarks, I got quite a different impression. Yes, he urged a wait-and-see attitude, but he was also sharply critical of Trump and rested his hopes more on “those who are coming into power with him” than on the president-elect himself. That’s a bold thing to do with a leader who has a proven capacity for vengeance. I thought it was more than a bit courageous on Scott’s part, actually.

Not so much with his comments on the newly-opened, grossly inadequate, and budget-bustin’ family shelters. On that score, he was deeply disingenuous — and the assembled reporters let him get away with it.

Are We Sure the Green Mountain Care Board Knows What the Hell It’s Doing?

Shots fired!

In response to revenue cuts ordered by the Green Mountain Care Board, the University of Vermont Health Network is slashing services at multiple locations. Most egregious, to me, is the closure of Central Vermont Medical Center’s inpatient psychiatric unit.

Reminder that we’ve had a chronic shortage of inpatient psychiatric space more or less continuously since 2011, when Tropical Storm Irene put the final nail in the old Waterbury state hospital’s coffin. And now we’re cutting eight beds?

A cynical observer might infer that UVMHN disagrees with the Board’s mandate, and is forcing the issue with unpopular and/or unworkable reductions. Seven Days’ Derek Brouwer wrote that the Network’s announcement “ratchets up a long-simmering tension” between the Health Network and the Board.

The Board was in a ratcheting mood itself. It issued a huffy statement Thursday afternoon expressing deep concern with the cuts and asserting that it “was not consulted on, and did not approve, these reductions.”

Well, boo frickin’ hoo.

After the Long, Dark Night, a Journey Through the Desert

In my Election Night post, I pointed out the parallels between Vermont’s elections in 2014 and 2024. Both were rebukes of Democratic officeholders; the former, Peter Shumlin; the latter, a couple dozen or so members of the Legislature.

There are parallels, to be sure but they end here: 2014 was largely aimed at Shumlin, while the entire Democratic establishment found itself in the crosshairs this year. And each and every one of them had better be prepared to do some real soul-searching. Because they didn’t see this coming, not at all. They believed the Democratic base was solidly in their corner. Some slippage was expected, but nothing like this.

Behind their misperception of the electorate is a more serious disconnect: Over the last two years, they completely lost touch with the people. They pursued an ambitious legislative agenda and, thanks to House and Senate supermajorities, they enacted an unprecedented number of bills despite gubernatorial objection.

They believed in their agenda. They believed they had a mandate to deliver on the promises of 2022. They believed they were moving Vermont toward a more prosperous and equitable future. One of two things is true: They got the agenda badly wrong, or they completely failed to connect it with the hopes, fears and concerns of the voters, especially outside the cities and suburbs.

Well, there’s a third factor: They made mistakes in crafting legislation. The most impactful was whatever they did to school funding that led to the unintended consequence of substantial property tax hikes for many Vermonters. It’s not easy to make sweeping changes in complex systems. The Legislature has precious few resources of its own, and was operating without any help from Phil Scott’s executive branch.

How Not to Debunk a Myth

The latest edition of “Brave Little State,” Vermont Public’s question-answerin’ podcast, addresses a widely-held belief that our homelessness problem is largely caused by people moving to Vermont to take advantage of our motel voucher program. And addresses it poorly, incompletely, and at great length.

The episode is entitled “Is Vermont’s motel program a ‘magnet’ for out-of-staters experiencing homelessness?” There is no evidence for the notion. In fact, there is a body of research showing that people in distress don’t cross state lines in any real numbers in hopes of accessing better benefits. Reporter Carly Berlin, whose work is co-published by Vermont Public and VTDigger, gets there eventually, but takes a godawful long time to do so. In the process, she manages to distort the basic issue, omit crucial aspects of the story, and get some key facts wrong.

The fundamental problem isn’t with Berlin or her many co-producers and overseers. (A total of seven Vermont Public staffers are cited in the closing credits.) The problem is that the issue was subordinated to the format. This wasn’t a story about homelessness and benefits; it was A Reporter’s Journey In Search Of Truth, filtered through the highly developed process of long-form public radio storytelling pioneered by Ira Glass’ “This American Life” and refined in this age of public media serial podcasting. The end goal of the production is more esthetic than journalistic.

This question can easily be resolved, but that’s not how you build a podcast. A long-form narrative needs a build, a measure of suspense, unexpected twists and turns, even if the actual path is pretty straightforward. Which is how you wind up with a 38-minute-long piece of audio that kind of bungles the assignment.

Mother Nature’s Punching Bag

I can remember a time, not that long ago, when we believed the worst effect of climate change on Vermont would be a potential influx of climate refugees — people from coastal areas looking for safe havens in the hills and mountains of our state.

Yeah, about that.

We’re getting hit, very hard and very often, by the consequences of climate change in ways that outstrip all those places we used to look at with more than a touch of Green Mountain smugness. I’ve certainly wondered why people even live in the lowlands of Florida or Louisiana or Texas or why they hold onto beachfront property that’s being eroded away. Don’t they know better? Can’t they see the signs? And why should they expect the rest of us to underwrite their bad decisions?

Yeah, about that.

Rarely, if ever, have I seen a bunch of bad news on any subject to compare with what we’ve seen lately about how Vermont is in the crosshairs of climate change. It all adds up to one conclusion: Far from being immune, Vermont is in many ways uniquely vulnerable. We are at risk. And we’re repeatedly seeking help from others, who could understandably ask why they should bail us out when we insist on living in disaster-prone places like flood plains, riverside communities, or out in the countryside along dirt roads and unpaved driveways that can easily wash away. Our Political Betters Are Strangling Vermont State University

A tremendous piece of reporting by VTDigger’s Theo Wells-Spackman lays out the dire situation facing Vermont State University and, although it sticks to the cautious, both-sides nature of modern journalism, it pretty much points the finger at the real culprits: Gov. Phil Scott and the Legislature.

It’s not a pretty picture. Falling admissions, leadership turmoil, cutbacks across the board, more cuts coming down the pike, half-empty (or worse) campuses, morale in the toilet. In short, something that looks just like a death spiral. And barring a sudden influx of resources from a state that has always shortchanged higher education, it’s hard to see how VSU pulls out of it. I’m sure it will survive in some form, but there’s no way it can become the robust, lower-cost, in-state alternative to the University of Vermont that we need it to be.

The situation would be bad enough, but the real killer is the state’s insistence that VSU maintain operations at all five of its campuses while implementing a painful series of state-mandated budget cuts.

The Best Senator Money Can Buy

I guess Stewart Ledbetter is serious about this midlife crisis “running for office” thing. Because of all the campaign finance filings submitted by yesterday’s deadline, the former WPTZ anchor slash cromulent host of “Vermont This Week” reported a truly eye-popping $49,189 in donations — the vast majority in increments of more than $100.

And if there was any doubt about his centrist leanings, a perusal of his donor list would drown all uncertainty under a tsunami of conservative and business community cash. The Big Boys want to see Ledbetter in the Senate.

Where do I even begin? How about this: Ledbetter got big-dollar gifts from a total of 51 people. The average donation from each? A smidge under $900. And heck, if you roll in the 50 small donors, the average single donation to Ledbetter for Senate was a hefty $477.12.

He’s rollin’ in it. Can he buy a Senate seat? It remains to be seen, but he’s sure as hell trying.

Phil Phones It In

For weeks, Gov. Phil Scott has been asking legislative leadership to “come to the table” and reach common ground on the school funding situation. On Wednesday, they came to the table — and the governor was nowhere to be found. He stiffed ’em.

He stiffed ’em physically by not showing up, and he stiffed ’em intellectually by presenting yet another half-baked, fiscally irresponsible “plan” for buying down property tax rates.

To me, his no-show proves that he didn’t want a deal that might be politically difficult. He’d prefer that the Legislature override his veto of the Yield Bill so he can use it as a campaign issue in hopes of eroding the Dem/Prog supermajorities.

Look, if he wanted a deal, he would have been there. If there was going to be a serious effort at compromise, he would have had to be there. His officials couldn’t have conducted meaningful negotiations in his absence.
