The political significance of the state [bleep] chair

First it was Seven Days, and now it’s VTDigger, reporting on State Rep. Bob Helm’s hidden-camera appearance in a TV report about the American Legislative Exchange Council. ALEC is the organization that spreads conservative policy ideas and provides sample legislation to Republican lawmakers nationwide.

Helm was attending an ALEC conference when he was buttonholed by someone he didn’t know was a TV reporter. He told her he was “the state [bleep], the state chair of ALEC,” and acknowledged that lobbyists had helped pay the freight for him and numerous other lawmakers.

The reporting raises questions of ethics and influence-peddling; but to this Political Observer, the most interesting aspect is the growing influence of ALEC in Vermont Republican circles.

Helm boasted to VTDigger that “he has ‘revved up’ the ALEC chapter in Vermont and has boosted the number of members to 20, up from four just a few years ago.”

I’d love to see that membership list. I’ve heard, for instance, that Burlington Rep. Kurt Wright, who tries very hard to position himself as a moderate, is an ALEC member. That may or may not be true, but Wright did push very hard in this year’s session for a bill banning teacher strikes — an idea that’s been promoted by ALEC in other states.

But the bigger point is, 20 may not seem like a lot, but it’s a substantial fraction of the Republican legislative caucus.

A new path forward for Peter Shumlin?

Maybe he’s pulling a Tom Salmon, and planning to run as a Republican next year.

Nah, I doubt it. But it’d explain the sudden, aggressive, and decisively centrist re-insertion of himself into legislative debates. At the very last minute. After months of serenely floating above it all, and letting lawmakers shred his proposals to pieces.

The latest comes from VTDigger’s Anne Galloway, who tells us that the top Senators on taxes and spending were yanked into the Governor’s office yesterday afternoon to get an earful of his displeasure with the current budget and tax bills. According to Galloway, he “hates the tax bills from the House and Senate and would prefer to cut more from the budget.”

And:

While it’s the governor’s prerogative to influence the legislative process and ultimately sign or veto the legislation, Shumlin’s down-to-the-wire timing perplexed insiders who say the governor has had four months to influence the budget and tax bills, and has not made a concerted effort to do so until now.

… “Disrespectful” was a word several people used to described Shumlin’s late-game tactics.

He certainly seems to have adopted a scorched-earth approach toward his relationship with the Legislature — after promising, after the 2014 election, an open and collaborative approach. You know. that listening and learning stuff.

The Indiana thing — Updated with response from top Republican

I think it’s time to hold Vermont Republicans’ feet to the fire on Indiana’s new “legalize discrimination” law. Usually, I’d give the VTGOP a break with regard to the massive insanity in their national party; our own Republicans are a feisty bunch, but they hardly ever* cross the line into sheer stupididity.

*Well, there was that time when party chair Dave Sunderland outed himself as a climate-change denier. 

STATE.SERVESBut the time has come. I realized this last night, when Rachel Maddow noted that every major Republican candidate for President has made statements in support of the Indiana law — in spite of its repudiation in national polls and by the normally GOP-friendly business community. (Even the notoriously politics-averse sports world has had to acknowledge the situation.)

I’m not just talking Ted Cruz and Rand Paul here. Endorsements of the Indiana law have also come from the likes of Scott Walker and Jeb Bush, who allegedly represent the “moderate” wing of the GOP.

And that makes it relevant to the Vermont party. What are we to think of the Republican brand, when every one of its potential presidential candidates has come out in support of legalizing discrimination?

Vermont Republicans like to claim that they are different than the national party. But when the national GOP has no room for a mainstream view on such a fundamental — and simple — issue, it’s time to ask exactly how Vermont Republicans are different.

At the very least, they should unambiguously declare their opposition to laws like this one.

This has become the issue of the moment on a national stage. It appears to be a turning point that finds the Republican Party on the wrong side of history. And on the wrong side of “right and wrong” itself.

So what say you, Dave Sunderland? Jeff Bartley?

It was (is) a stupid law, drafted by people who either didn’t understand the ramifications or who had an agenda that America should not be following. If they were the former, they need better legislative council; if the latter, I’m surprised to see that element in Indiana.

But that’s just MY opinion.

A self-selected “champion”?

Now that we’ve caught up with Campaign for Vermont’s effort to co-opt our town clerks, let’s check in with CFV founder and funder Bruce Lisman.

Well, Bruce is doing pretty much what he’s been doing — just on his own platform, the humbly named “brucelismanvt.com.” Same faux-centrist pro-business rhetoric, same slightly constipated looking smile on his face.

Bruce is blogging now, but you can’t just click over and read it; you have to “subscribe.” I’d rather die.

It’s not a paid subscription; all you have to do is provide Lisman with your contact information. Yep, he’s building a mailing list.

Running for Governor? I’ve said it before and I’ll say it again: Bruce Lisman will never be Governor of Vermont. He’s not terribly well known, in spite of his travels around the state; he’s a lousy campaigner and public speaker; and most importantly of all, Phil Scott stands squarely in his path. Scott is a much better advocate of pretty much the same policy ideas. He’s far better known, he’s a more effective speaker and a proven fundraiser, and he has a major party structure behind him.

Lisman is also Tweeting, occasionally. His latest 120-character opus:

The real lessons of Plasan

Vermont’s pro-business community couldn’t hardly wait to score a cheap political point (and, as usual, soil the state’s reputation) after Plasan’s announcement that it was relocating to Michigan. Decent interval, bah: we’ve got a boilerplate press release ready to go.

Lt. Gov. Phil Scott did the honors for the VTGOP, offering a quick word of sympathy to Plasan’s workforce and then pivoting to the red meat:

This announcement is yet another clear sign that we in Montpelier must put our full focus on not only protecting, but on growing Vermont’s economy and face the reality that we are competing in a regional, national and global marketplace. We cannot continue to blame “forces beyond our control” for our job losses, but turn the mirror back on ourselves and ask ourselves: “What can we do to change the direction of this trend? How can we make Vermont better?”

The best part is Scott’s dismissal of “forces beyond our control,” when Plasan made it abundantly clear that Vermont’s business climate had nothing to do with its decision, and Vermont couldn’t have done anything to change it. But let’s not let a little inconvenient truth get in the way of a stale talking point.

Former Wall Street supremo Bruce Lisman kept it simple; he made time for one self-congratulatory Tweet, with nary a word of sympathy for the workers.

Nice, Bruce. Way to show your concern for the common folk.

Okay, so the Usual Suspects reacted in the usual way: grabbing at any available pretext for regurgitating their political cud. (Please chew with your mouths closed.) But there are lessons we can learn from the departure of Plasan and other industries, and things we should bear in mind.

FIrst, let’s re-examine the unique strengths of Vermont. We do have our share of weaknesses, even if you omit the tired bromides of rightist politicos. So why do so many businesses establish themselves here or move here? Why does anybody stay? Why don’t they all move to Michigan or Texas or Mississippi?

Quality of life must be near the top of the list. Our topflight public school system is a draw. We have some very nice cities and small towns, good places to call home. Low rates of violent crime. Abundant recreation. A market small enough that entrepreneurs can gain a foothold before venturing out into the big time. (Ben & Jerry’s would have had a much harder time starting out in a big state with big distribution systems.)

I’m sure there are others. My point is, before we try to tear down Vermont, let’s figure out what we’re good at, do what we can to make it even better, and market the hell out of it.

Okay, so now: what are our weaknesses?

We should certainly review the items on the VTGOP hit list. If there are ways to smooth regulatory pathways without selling our souls, great. If forms or bureaucratic procedures are cumbersome, simplify them. But there’s no way we can compete with bigger states or other countries on things like taxes and incentives. Vermont can’t come anywhere near the packages being offered by New York state, for instance. We can’t be as low-tax as Florida or as development-friendly as Arizona, nor would I want us to be. That’s why our first priority should be identifying and maximizing our strengths.

Beyond the usual GOP talking points, I see three major areas that are drawbacks for Vermont’s business climate. In no particular order:

The high cost of post-high school education. It’s the one thing we consistently hear from business owners (as opposed to their political mouthpieces): “We can’t find enough skilled workers. We can’t fill available jobs.”

The cost of attending our public colleges and universities is absurdly high — especially at the community college level. Governor Shumlin has done some incremental things to nibble away at this problem, but has failed to tackle it in a thorough, systemic way.

Getting around. When Chris Graff wrote his memoir a few years ago, he ranked the top stories in recent Vermont history. His pick for #1: the coming of the interstate freeways. They made it possible to travel and transport goods much more quickly, at least in certain corridors. They brought dramatic change to Vermont — mostly for the good.

But large stretches of Vermont are still remote — or remote enough that it’s a significant competitive disadvantage. The biggest obstacle for places like Bennington and Rutland is the lack of high-speed roadway. The best thing we could do for them is turn U.S. 7 into a freeway. We could also use speedier corridors across central and southern Vermont.

(We pause while liberal readers gasp for breath.)

Also, and just as significantly, we need more public transportation. This is a tough nut to crack in a place with a small, scattered population, but if it was easier to get around Vermont without a car, it’d help convince people to live somewhere besides Chittenden County.

The lack of housing, for purchase and rental. One of the biggest drags on our economy is the aging demographic. What do young families need? Rental properties and small- to mid-sized houses. Just what we don’t have.

This is one area of regulation that needs to be loosened in a targeted way. We need to do more to encourage affordable housing — by which I don’t just mean Section 8 or mobile homes, I mean houses costing less than $250,000 and enough rental stock to keep rents reasonable. I’d like to see an emphasis on in-fill housing in existing cities and towns. I don’t want to open the regulatory door to more suburban sprawl.

Housing affordability touches on a fundamental problem with our 21st Century economy: wage stagnation in the middle and working classes. Part of the problem with affordability is depressed wages, something that’s beyond the scope of this post. But as long as young people are starting their lives with college debt and low salaries, we need to help them find housing that fits their budgets.

So there you have it. My initial prescription for improving Vermont’s business climate. And it has nothing (much) to do with taxation or regulation.

The drift

The legislature is about a quarter of the way through its four-month session, and Governor Shumlin’s proposals are falling like tin ducks in a shooting gallery. Lake Champlain tax plan? Dead. Education plan? “A place to start the conversation.” Payroll tax to close the Medicaid gap? Flatlining.

Not that this is terribly surprising; the governor exited the 2014 election with significantly diminished political capital. So much so that when Shumlin unveiled his proposals last month, the question wasn’t so much whether they would pass or not, as whether he meant them seriously in the first place or knew from the start that they were doomed.

(Evidence for the latter: an education plan that did nothing to provide near-term property tax relief. That, at least, was a non-starter.)

Not sure what else he could have done after his near-defeat. He could have taken the George W. Bush approach, pressing on regardless of his mandate-free victory, but that’s not who he is. Shumlin likes to talk bold and act incrementally.

Now he’s added deference to incrementalism, and it’s up to the Legislature to generate some vision. The consensus-seeking, conflict-avoidant Legislature. I’m not holding my breath.

I do expect our lawmakers to do some good work; I just don’t expect them to produce anything truly impactful. And we face a bunch of issues that call for some strong, progressive action.

Take, for example, the House Fish, Wildlife and Water Resources Committee, chaired by one of the good people of the Statehouse, David Deen. The committee has already ditched Shumlin’s proposed tax hikes to help pay for Lake Champlain cleanup. The fertilizer fee’s down the tubes because the farmers didn’t like it; the fee for stormwater runoff from developed sites is as good as dead because it would be “difficult to implement.”

Instead, Deen’s panel is looking at a smorgasbord of tax and fee hikes — more numerous than Shumlin’s plan, and less directly tied to the sources of Champlain pollution. The governor’s plan was simpler and made more sense. The committee’s approach will open the door to Republican charges that the Dems are just raising taxes wherever they can. Deen is considering at least four separate tax or fee increases instead of Shumlin’s two.

More important than the specifics of the Champlain plan, though, is the strong signal it sends: Lawmakers — even those who are solid on policy — are loath to take risks. Or, as Deen himself put it:

“There are some very strong voices in the hall opposed to it. And we are reacting to political reality around here,” the Westminster Democrat said Friday.

This session is looking like a big fat lost opportunity given that this is an off-year, and new programs or reforms would have a year and a half to take root before lawmakers have to run for re-election. Ya think next year’s gonna be any better?

This is a typical duck-and-cover reaction, but it plays right into the Republicans’ hands. Let’s say Phil Scott runs for Governor, as everybody believes he’s going to do. He’s strongly positioned as a centrist willing to consider all ideas. And he’s a nice guy to boot.

If voters have a choice between the Democrats’ fear-based centrist incrementalism with a bias toward inaction and Phil Scott’s natural centrist incrementalism with a bias toward inaction, which one do you think they’re going to choose?

I hope I’m wrong about this. It’s still early in the session, and there’s more than enough time to come up with at least one piece of solid small-p progressivism. But I’m not holding my breath.

Dan the No Longer Libertarian Man

(UPDATE: Per VTDigger, he’s joined the Republican Party. See below.)

Here’s a little piece of political news so shocking that I almost stifled a yawn.

Oooooookay, then. I imagine this will rattle around the Vermont political media for a few hours and then we’ll get back to stuff that actually matters.

Not to disparage the contributions of Mr. Feliciano. But we are talking about a guy who enjoyed a boatload of free publicity, including widespread speculation that he might outpoll Scott Milne, and in the end he barely managed to fend off the bottom-of-the-ballot Nutbar Brigade. He couldn’t even push the Libertarians into automatic ballot status for 2016.

I can see three possible implications. In order of likelihood:

— He’s had enough of politics and will turn his attention back to work and family. 10% chance; once bitten by the political bug, the fever usually persists beyond one election cycle.

— He doesn’t know what’s next, he’s on the outs with the Libertarians anyway, so he’s clearing the decks. 30% chance; it’s neat and clean, but I suspect he has an idea what he wants to do. Which is…

— He’s aiming to run for governor in 2016 as the darling of the right wing. 60% chance. The opening is there, unless Randy Brock re-emerges from the weeds. (Which I doubt.) The right needs a front man with some sort of credibility, and Feliciano was a perfectly cromulent candidate in 2014. He’s got some name recognition, he’s got a foothold in the Vermont political world. He impressed the likes of Darcie Johnston, even if he pretty much failed with the electorate.

There are problems with this scenario, obviously. His “proven appeal” amounts to 4% of the vote, even with all the publicity he got and all the troubles of his Republican counterpart. He’d be aiming to represent a wing of the VTGOP that’s clearly on the outs; if the 2014 election proved anything, it’s that a center-right position is much more appealing to voters than a hard-right stance.

Plus, in a hypothetical primary against Phil Scott, he’d get flattened.

Of course, the fact that the right wing is clearly on the outs makes them desperate enough to see Mr. Four Percent as their knight in fiscally conservative armor.

UPDATE: VTDigger’s Tom Brown reports that Feliciano has joined the Republican Party, saying its larger base would give him a better chance of winning a future campaign. That might be another run for governor; he might also pursue another office:

“It depends on what it is,” he said. “I have to be in a position where I can really influence things and get things done. I would not be good in the middle.”

I think we can all agree on that.

A passel o’ peevishness on Inauguration Day (Part Two)

In Part One, I mused about the overreactions and hurt fee-fees on both sides of yesterday’s Inaugural protest. Now, let’s turn our attention to the Republican reaction to Gov. Shumlin’s inaugural address.

Their main point, according to VTDigger’s Laura Krantz?

Gov. Peter Shumlin ignored the most pressing issues facing Vermont in the first speech of his third term, Republican leaders said Thursday in response to the inaugural address.

… Republicans, gathered in the Senate cloakroom, said they were disappointed Shumlin ignored property taxes and health care — two issues that topped voter concerns during the elections last fall.

The speech focused on energy and the environment, so the complaint is technically accurate. But it deliberately ignores the fact that Shumlin billed this speech as Part One of a two-part 2015 agenda. And the governor specifically said he will address the “missing” issues in next week’s budget address.

“Just because the governor has acknowledged that his plan is a failure doesn’t mean he can ignore health care. We still need to address it,” said Rep. Patti Komline, R-Dorset.

Well, he didn’t “ignore” health care. He said he’d address it next week.

Sen. Joe Benning, R-Lyndonville, said the speech focused not on saving money but on spending more.

Again, the budget address hasn’t happened yet. That’s when Shumlin promises a plan to balance the budget. And, for the fiscal conservatives among us, Shumlin’s energy/environment speech contained very little in the way of new spending. The energy part was mainly about new regulation of renewables, which doesn’t involve any state spending. The Governor did propose two fees to help fund Lake Champlain cleanup, but both are narrowly targeted on sectors that contribute heavily to Champlain’s problems — agriculture and commercial/industrial development.

Republicans said they are open to his ideas about cleaning up Lake Champlain and other waterways but those are not the big problems.

Well, actually it IS a big and urgent problem because, as they well know, the EPA is holding Vermont’s feet to the fire. If we don’t come up with a solid plan, including new funding, then the feds will come down on us hard. That makes Champlain a top priority.

Speaking of new urgency, here’s another Republican missing the point.

“It needs doing but where was he four years ago on this?” said Rep. Brian Savage, R-Swanton.

Well, he was doing the same thing Jim Douglas did before him: postponing the Day of Reckoning as long as possible. As Rep. Savage well knows, the EPA has run out of patience, so Shumlin can’t possibly put it off any longer.

 Argument is an intellectual process. Contradiction is just the automatic gainsaying of anything the other person says.

House Minority Leader Don Turner was his usual obstructive self, strongly opposing any new taxes or fees, and even blasting Shumlin’s proposal to use the current use law as an enforcement mechanism for farmers and loggers. And he did so in a stunningly inarticulate fashion:

“I think that we know that current use is a very popular program, and it is a very expensive program. But if we want open land in Vermont its been one of those tools that has worked really well,” he said.

So wait. Current use is “very expensive,” and, in fact, Republicans have called for new limits on the program, but it’s “worked really well” and we can’t possibly do without it. You’d need a couple hours of pounding ’em back at the Capitol Plaza bar before that started to make sense.

The entire Republican response consisted of the automatic gainsaying of anything Shumlin said.

With one exception. Lt. Gov. Phil Scott released a statement that began thusly:

“I was encouraged to hear the Governor talk about economic growth. It was good to hear about the Governor’s support of research and development, especially after this important incentive was reduced last year. I hope that the Governor’s mention in his speech today is a precursor to a proposal included in the budget next week.”

Admittedly Scott sort of bent Shumlin’s message in his own direction, but look at what he did:

— He identified common ground instead of just saying “No.”

— He acknowledged that the inaugural address was Part One of Shumlin’s agenda.

A hint of politics, but overall gracious and inclusive. That’s the way you do it.

The Legislature’s vote for governor will not be close

The Man Alone, Scott Milne, briefly emerged from his hidey-hole a few days ago to tell the Associated Press’ Dave Gram that his chances of being elected governor “are getting better on a weekly basis, if not a daily basis.”

Curious thing to say, with less than a week until the vote. Speaking calendrically, there ain’t no more “weekly” left. But if you think that’s a bit confusing, wait till you read what he told VTDigger’s Anne Galloway: 

Milne said on Sunday his “chances are improving.” When asked how many lawmakers support his candidacy, he said his statement was “non-mathematical.”

“I’m not counting votes, and if I was, I don’t think I’d have close to 91,” Milne said. He said he could get 25 or 100 votes, but “more likely I’m going to lose, I don’t really know.”

I make that a quintuple spinaroonie: up, down, down, up, down. Whatever happens, he’ll be both disappointed and vindicated, I guess.

Anyway, if he thinks he’s gaining ground, he’s wrong. The Legislature’s vote will not be close. Gov. Shumlin will win, with perhaps a handful of Democrats crossing party lines to vote for Milne.

At this point, the cynical among you might be saying, “Hey, didn’t you predict an easy win for Shumlin in November?”

Yup, me and every other pundit and politico in Vermont. But I feel confident enough to tiptoe out on a limb once again. The Legislative vote is a whole different animal than the general election.

In November, a whole lot of liberals and card-carrying Democrats voted for someone other than Shumlin or simply left their ballots blank. There’s substantial evidence that the Democratic vote was far smaller in the gubernatorial race than elsewhere. It was easy to cast a protest vote when “everybody knew” that Shumlin would win. I certainly believed that Shumlin didn’t really need my vote. After the results came in, a liberal friend who voted for Milne swore never to cast a protest vote again.

The ironic but unmistakable conclusion: if people had thought the race was close, Shumlin would have done better. To put it another way, if voters had thought they might actually elect Scott Milne, he wouldn’t have done so well.

In the legislative vote for governor, there’s no kidding around. When you’re one out of 200,000, you can tell yourself your vote doesn’t count that much. When you’re one of 180, you really can’t. Each lawmaker is going to take the vote seriously.

And while leadership insists they aren’t twisting any arms, party discipline does — rightly — play a role. Parties are based on some sense of shared purpose and loyalty, which is why I’ve been so harsh on John Campbell and Dick Mazza for their open support of Lt. Gov. Phil Scott.

When push comes to shove, and all the cards are on the table, how many Democrats are really going to vote for the other guy? Even if the ballot is secret, it wouldn’t be hard to figure out who voted which way. I expect Milne to get a modest number of Democratic votes, but no more than that.

Besides party loyalty, there’s also Vermonters’ tendency to stick with the familiar. Shumlin may have lost a lot of voters, he may have cost some lawmakers their seats, he may have turned his back on his signature policy proposal, but he’s still “Our Guy.” If the Senate Democratic Caucus gave near-unanimous support to Our Guys John Campbell and Dick Mazza, how many would abandon Peter Shumlin, who’s another one of Our Guys?

There’s also this: Just about everybody in the Statehouse knows that Scott Milne would be a disaster as governor. Well, at best he’d be a two-year placeholder. At worst, Legislative leadership would work around him. But nobody except Scott Milne wants Scott Milne to be governor.

Including all the Republicans who’ll vote for him on Thursday. I’ve written this before and it continues to be true: do you ever see Milne and the top Republicans together? Do you see any mention of “Governor Milne” when Republicans talk about their plans?

Is Milne involved at all in Phil Scott’s little “pitch session” with business leaders on Wednesday?

Nope, nope, and nope.

If the Republicans believed that Milne had the remotest chance of winning, they’d have him out front at every VTGOP event. But they don’t, in spite of their utterances to the contrary, so he remains The Invisible Man.

And on Thursday, he will formally become the losing candidate for governor. As he should be.

(And if I’m wrong, I will cheerfully fess up.)

Single payer: a third party is heard from

I’ve been wondering when this would come. A statement, with the title in ALL CAPS, from the Progressive Party:

SHUMLIN’S DECISION TO SCRAP SINGLE PAYER A BETRAYAL OF VERMONT’S WORKING FAMILIES

And no, the Progs don’t usually go ALL CAPS.

The reaction is understandable; the Progs had put their statewide ambitions largely on hold for the sake of single payer.

The Vermont Progressive Party dis not run Progressive challenges against Governor Shumlin in the last three cycles, in large part because of his unwavering promise to lead on single payer.

If the Progs had run a candidate this year, no matter how perfunctory, we’d almost certainly be talking Governor-elect Milne right now.

The anger continues:

While we are outraged by Shumlin’s broken promises, we are not terribly surprised. … rather than work through [the] issues or scale back the project, Shumlin decided to scrap it entirely (and with it, many Vermonters’ hopes of a just and accessible healthcare system).

Indeed, it’s easy to conclude that the Governor put his thumb on the single payer scale in order to make it seem more unattainable than it already was. He opted for a top-level plan (94 Actuarial Value) instead of more modest coverage (80 AV), which increased costs. He insisted on a three-year phase-in of the payroll tax for small businesses, which slashed revenues. (His team also suddenly realized that those long-touted “administrative savings” weren’t going to happen.) Those may have been reasonable policy choices, but when you have Shumlin’s reputation for slickness and hippie-kicking, it’s not hard to assign the worst possible motive: the Governor wanted to squirm out of his promises, so he stacked the deck against single payer.

Governor Shumlin only seems concerned about the projected future economic burden to businesses, not the burden that working people are bearing right now.

Yup. His announcement was chock-full of references to financial realities and business concerns — and reminders of his own personal pain, awww — while conspicuous by their absence were any mentions of equity, accessibility, or the burdensome nature of the current system. And he sure as hell didn’t call health care a “human right.”

The Progs’ release includes a not-so-veiled threat of a Progressive candidate for Governor in 2016. Imagine, if you will, this scenario:

Shumlin has spent his third term tamping down expectations, cutting programs to balance the budget, pursuing incremental rather than transformational progress. The Republicans nominate Phil Scott, who doesn’t look much different ideologically than Shumlin, has a much more attractive personality, and can win back the business donors who’ve been backing Shumlin.  And the Progs challenge from the left.

In that scenario, Shumlin is well and truly screwed.
