The Unbearable Weirdness of Being Attorney General

Over the years, I have written some unkind things about the last two Vermont Attorneys General, Bill Sorrell and TJ Donovan. I can’t say I regret anything in particular. But in light of recent events, it must be said that some of their actions have less to do with political timidity or personal fecklessness and more to do with the inherent weirdness of the office itself.

Our current Attorney General, Charity Clark, has been all over the news this week. She joined other AGs in challenging the Trump administration order ending birthright citizenship. She announced a multi-billion-dollar settlement of a lawsuit against the Sacklers and other bigwigs of Big Pharma responsible for an epidemic of substance use disorder. Strong stuff.

At the same time, her office was before the Vermont Supreme Court defending Gov. Phil Scott’s appointment of Zoie Saunders as interim education secretary. Yes, a Democratic AG was taking the side of a Republican governor in a lawsuit filed by a Democrat and a Progressive.

Because she had no choice. Clark, like Donovan and Sorrell before her, can act like a progressive firebrand outside of Vermont, but she must defend the status quo within the state. It’s literally in her job description: She is the people’s lawyer, yet she also represents the state. And when those two notions are in conflict, her duty to the state comes first.

Here’s another encapsulation of the weirdness. Clark is pursuing a suit (originally filed by Donovan) against fossil fuel producers for knowingly contributing to global warming. But Clark would represent the state in a suit filed by the Conservation Law Foundation over the state’s failure to reduce greenhouse gas emissions. She’d be arguing against climate action. Not because she’s an environmental hypocrite, but because she is legally bound to represent the state in court.

Statewides: The Haves and the Have Nots

The September 1 campaign finance reports crystallized something we already knew: This is shaping up to be an unsurprising political season because there’s such a deep divide between those on top and those trying to get a leg up. The former include Gov. Phil Scott and a whole bunch of Democrats; the latter include every other Republican minus a few who’ve been blessed by the patronage of Burlington’s business elite.

The exception to the Democratic rule: Esther Charlestin, who entered September financially underwater in her long-odds (and getting longer every day) gubernatorial campaign. Somehow, the financial gap between Scott and Charlestin managed to grow in August.

This isn’t a typo: Charlestin has raised only $21,137 and spent $22,309. On primary night, Charlestin told VTDigger she would “go hard” in the general campaign, which meant knocking on doors, seeking endorsements, and “raising a lot more money.”

But she didn’t do that. For the entire month of August, Charlestin raised $4,505, which isn’t anywhere close to “a lot more money.” I can’t say how much of this is her doing and how much is Democratic donors turning their backs; Charlestin didn’t score any donations above $250, and that came from longtime Progressive stalwart Martha Abbott. Hey, Dems: Do you like your candidate or don’t you?

Meanwhile, Scott continues to raise far more money than he needs, and spend money like he’s got an actual battle on his hands instead of an almost certain walkover.

More Money Than Sense, and Other Notes from the Latest Round of Campaign Finance Reports

August 1 was another campaign finance deadline, the last before our August 13 state primary. As usual, there was plenty of interesting stuff to be found. And as usual, there was a dearth of coverage in our sadly diminished media ecosystem. VTDigger waited a few days to put together a solid campaign finance database helmed by its longtime (by Digger standards) data reporter Erin Petenko. But any effort, by anyone, to identify trends or develop insights? Haven’t seen any.

Meanwhile, those who follow me on Elon’s Hellscape know why I’m late to the party. After doing a fair bit of spadework around the deadline, I came down with Covid. It was a pretty severe case for a few days and I’m still on the mend, but I feel able to put words on the screen for the first time since last Thursday.

Anyway, got some things to say. Let’s do the toplines first and then get to the details.

  • While the vast majority of candidates have trouble scratching a few bucks together, there are a few who have more money than they know what to do with. The primary’s one week away, early voting as been going on for roughly a month, and they’re sitting on large quantities of unspent cash.
  • Many of these hopefuls have been generously funded by a cadre of Burlington-area business types, who may look at their investments post-primary and despair at the improvidence of their strategery.
  • Two candidates got a rocket strapped to their backs by those business leaders in July. John Rodgers, running for lieutenant governor, and Rep. Pat Brennan, running for state Senate. They went from near zero on July 1 to huge, nigh unspendable hauls on August 1. Congrats, I guess?
  • Gov. Phil Scott’s campaign has far outstripped Democrat Esther Charlestin. Why his people are bothering to beat the bushes, I don’t know. I remain convinced that he’d be better advised to mothball his campaign and start a PAC — or a Super PAC — and spread his influence around.
  • The oddities around Thomas Renner’s campaign for lieutenant governor continue to proliferate. His fundraising slowed to a trickle in July, but he spent very little and has a sizeable unspent reserve. I still don’t know what his campaign is about. Or who’s running it, for that matter.

Even By Phil Scott Standards, This Is a Stupid Veto

Gov. Phil Scott’s dozens upon dozens of vetoes fall into three rough categories:

  • Principled, which involve an honest philosophical difference between Republican executive and Democratic/Progressive Legislature.
  • Easily avoidable, in which Scott proffers an objection that could have been easily cleared up with a little effort during the session.
  • Transparently phony, in which Scott gins up some excuse for a veto because if he came right out and disagreed with a bill’s premise it might damage his “moderate” image.

Today’s veto of H.645 is a combo platter of number 2 and number 3, a particularly toxic blend. The bill would ensure equitable access to restorative justice programs. In other words, kind of a squishy criminal justice reform that wouldn’t appeal to someone who wants to be tough on crime. For instance, Phil Scott.

But instead of addressing the issue directly and risk tarnishing his centrist cred, he claimed that he had to veto the bill because it lacked the necessary funding to put it into practice. (His veto message is very brief and includes no hint of any other rationale.)

Implementation of the measure would be handled by the Attorney General’s Office, and unfortunately for Scott’s chosen rationale, AG Charity Clark quickly replied that her office could handle it with no problem, at least for the next fiscal year, with its existing resources.

Yeah, kind of embarrassing.

A Decent Interval Might Have Been Appropriate

On Monday, to the surprise of absolutely no one, Charity Clark launched her bid for re-election as Vermont’s Attorney General. In the process, she touted her role in protecting Vermonters from the excesses of big corporations and presented herself as a shield against “any immoral, illegal or unjust action taken by Donald Trump” should he become president again.

I have no problem with any of that. But while Clark does good work defending our interests against threats from outside Vermont, she is constitutionally constrained from doing the same when it comes to the actions of our own state government. When the state is challenged in court, the AGO acts as the state’s lawyer. Like, for instance, on the previous business day when the AGO was in court defending Gov. Phil Scott’s crappy shelter program against a challenge by Vermont Legal Aid.

And yay, they won the case. Yippee. Congrats on helping keep hundreds of Vermonters unsheltered. Drinks all around.

The contrast between Friday’s defender of an indefensible state policy and Monday’s champion of justice couldn’t have been more stark. Good thing for Clark that nobody seemed to notice. Well, I did, and I kinda wish she’d postponed her campaign announcement by a few days at least. Put a little distance between the two separate and often contradictory roles that our AG must perform.

You Will Please Ask No Questions About the EB-5 Disaster and, By the Way, Here’s the Bill

It was an “oh, by the way” moment for the ages. And an outrage against good government.

On Wednesday, Attorney General Charity Clark told a House committee that we, the taxpayers of Vermont, are on the hook for a $16.5 million settlement of the EB-5 scandal.

You know, the settlement that allowed key players to avoid the embarrassment and potential legal liability of testifying under oath? Yeah, that one.

Once in a while, an issue or development just hits me so hard that I find myself lying in bed wide awake, staring at the ceiling and grinding my teeth until I have no choice but to get up and write something. And here we are. Let’s recap the high points, shall we?

  • Through a combination of incompetence and hubris, state officials allowed themselves to be flim-flammed.
  • Other state officials then covered up the truth about the affair by claiming they had to keep key documents secret pending court cases.
  • On the eve of trial, the state settled a lawsuit by EB-5 investors just days before former state officials (up to and including former governor Peter Shumlin) were set to testify under oath.
  • If all those documents were ever released once the legal peril was removed, it somehow escaped my attention.
  • The state’s insurance company, AIG, took one look at this mess and denied coverage.
  • The state rolled over and accepted a token payment from AIG.
  • The Scott administration and Attorney General Charity Clark then waited as long as possible to reveal the AIG denial — only doing so when they had to go ask the Legislature for the needed funds.

Will the EB-5 Settlement Be an Open Window or an Escape Hatch?

Congrats to former governor Peter Shumlin, who will be spared the indignity — and potential legal peril — of testifying under oath about the EB-5 scandal, thanks to the state’s universal settlement of lawsuits by investors in the fraudulent scheme.

Regrets for the rest of us, who’ve been wondering for years what he knew and when he knew it

At the same time, hopes arise for the fullest possible disclosure of documents hitherto barred from public disclosure because of the state’s legal exposure. Well, that threat has been removed, right? So now we can expect a big press conference any day now where state officials will pull a curtain away from a mountain of documents and eliminate all the suspicions.

The Dem Statewides Are Doing Just Fine, Thanks

In a post following the September 1 campaign finance deadline, I noted that “three of the big Democratic primary winners emptied their coffers in an effort to get across the finish line.” It put them in a potentially hazardous position for the general campaign.

Well, it would have if their Republican opponents weren’t all unknown, unfunded, and largely unloved.

I speak of Charity Clark (attorney general), David Zuckerman (lieutenant governor), and Sarah Copeland Hanzas (secretary of state). Zuckerman had $16,771 in the bank on the first of September; Clark actually entered September with a $1,200 shortfall, Copeland Hanzas had about $12,000 on hand, but only because she reported loaning her campaign $14,000. So, according to her own report, she had a $12,000 deficit outside of her own pocketbook.

Well, hold on a minute. According to her campaign manager Lizzy Carroll, that $14,000 number was a mistake. The actual self-loan was $3,500, which is not insignificant but it does make her bottom line look a lot better. The deficit falls from $12,000 to about $1,500. (She carried forward a $1,160 surplus from past campaigns, which would lower her real deficit to less than $400.)

So, where are the three of them now?

No Money, No Problems

Turns out, three of the big Democratic primary winners emptied their coffers in an effort to get across the finish line. Now they’re strapped for cash entering the general campaign.

That’d be a real problem if their Republican opponents weren’t so utterly hapless.

Charity Clark went on a mass-media spending binge in early August. She spent a massive $81,000 in the month; $64,000 of that was for TV, radio, print, mail, and online advertising. She entered September with a cash deficit of about $1,200. Turned out she didn’t have to do all that spending, as she won her party’s nomination for attorney general over Rory Thibault by a better than two-to-one margin.

Sarah Copeland Hanzas’ war chest (obligatory war chest reference) was scraping bottom as the primary approached. She spent a relatively modest $15,602 in August, not much more than half what her rival Chris Winters spent. Copeland Hanzas had entered the race very late and never caught up in fundraising. She enters September nearly $12,000 in the black, but only because she loaned her own campaign $14,000.

Still, she won — by a scant two percentage points — and that’s what matters most.

David Zuckerman spent $57,149 in August as he sought to ensure victory over Kitty Toll, bringing his campaign spending total well over $200,000. He still has $16,771 in cash on hand, and an extremely large base of small donors who can be tapped for more.

A Tale of Two Treasuries

Obligatory “War Chest” Reference

As if it needed any more emphasis, the September 1 campaign finance reports starkly illustrate the difference in fortune between the Vermont Democratic and Republican Parties. In case you need to be told, the Dems’ war chest is on the left; the VTGOP’s is on the right. The exception is Gov. Phil Scott, who seems to finally be taking the campaign seriously. Maybe he’s a little worried about Brenda Siegel?

Fundraising numbers to date for statewide races besides governor:

Lieutenant Governor: David Zuckerman $236,687, Joe Benning $38,546. That’s the good one for the Republicans.

Treasurer: Mike Pieciak $126,500, H. Brooke Paige 0.

Secretary of State: Sarah Copeland Hanzas $74,078, H. Brooke Paige 0.

Attorney General: Charity Clark $129, 835, Mike Tagliavia 0.

Auditor: Invincible incumbent Doug Hoffer $100 plus a $1,115 surplus from 2020, Rick Morton 0.
