A slight but perceptible bend in the glass ceiling

The House and Senate Democrats will caucus tomorrow (Saturday) in Montpelier to choose their nominees for leadership positions. It’s been radio silence on the Senate side, which I take as a bad sign, but some news has come out of the House.

And for gender equity fans, the news is good.

As you may recall, Vermont does very well on gender equity in the House, less well in the Senate, and very poorly in statewide elective office and Congressional seats. Like, for instance, we’ve never sent a woman to Congress. Which is, well, shameful.

Back to the House, where Shap Smith will return as Speaker; but the new House Majority Leader, according to Seven Days’ Paul Heintz, will be Sarah Copeland Hanzas of Bradford. What’s even better for equity’s sake is that the other candidate for the post was also female: Kesha Ram of Burlington. Having two women in line for the House’s number-2 slot is a very good sign.

Ram dropped out, per Heintz, citing the need for geographic balance. She will apparently fill a new post, “caucus election chair,” which is being created to sharpen Democratic messaging and lend a hand to House candidates.

Those developments, plus Kate Webb returning as Whip, mean that women will be heavily represented on the House leadership team. And whenever Shap gets tired of herding cats, the next Speaker may well be a woman.

Over in the Old Farts’ Club, er, I mean the Senate, I’m not feeling the gender-equity love. I’d be very happy to be proven wrong, but I’m expecting the leadership in Vermont’s Most Stagnant Deliberative Body to remain pretty much the same.

By all accounts, John Campbell will keep the job as President Pro Tem in spite of the fact that he isn’t very effective unless he has a nanny to keep him in line. After the disastrous 2012 session, he hired Rebecca Ramos as his chief of staff, and things improved. She’s now a lobbyist, and according (again) to Paul Heintz, Erika Wolffing will take the job.

Wolffing was a Shumlin administration fixture who went to the Democratic Governors Association when Shumlin became its chair. Now that Shumlin is out at the DGA, Wolffling will reportedly become the hand that rocks Campbell’s cradle.

Which leaves me wondering why we let him hang around when he (a) apparently can’t handle the job without a lot of help and (b) openly supported Republican Phil Scott and seized every opportunity to shit on Dean Corren. But maybe that’s just me.

I’m sure the status quo will remain in the Phil Scott Fan Club, er, I mean, the Committee on Committees, the body that makes all the committee assignments. Phil Scott himself is a member by law, as is Campbell. The third, elected by the full Senate, is, was, and ever shall be Dick Mazza, a putative Democrat who was extremely vociferous in his support for Phil Scott.

Which leaves me wondering why, when the Dems have a nearly 2-1 majority, we have to settle for nominal Democrats on that very powerful committee.

The Democratic caucus will see some change with the none-too-soon departures of Bob Hartwell and Peter Galbraith, but I’d be surprised to see much happen with the leadership. It’d be nice, but I ain’t holding my breath.

Finally, for those who think I’m too mean to Mr. Campbell, here’s a little tidbit from last March. Campbell had stuck his foot in his mouth by openly doubting the prospects for single payer health care and talking about pursuing some alternative plan. (Bear in mind that Shumlin was still riding high at that point.) This reportedly enraged the governor. And a few days later, Campbell appeared on WDEV”s Mark Johnson Show and tried to walk back his earlier statement.

It was a complete fiasco. At one point Johnson asked him this question: “You dropped something of a bombshell this week that you want to start pursuing an alternative to the Shumlin health care plan. Why?”

And here, really and truly, was his answer in all its obfuscatory glory.

First of all, I guess it’s a question of how you define what my “bombshell” is. I think some people have taken it to mean what they really, what they want to hear from what I said. And basically, my, uh, my position is this, is that we are headed right now as far as the Legislature, we are going to be focusing on making sure that we have a publicly-financed, universal access to health care in this state, and that’s known as Green Mountain Care. As far as I’m concerned, I consider it Green Mountain Care, it’s a universal access program. Um, um, I charged my, in fact we spoke about it here on this program at the beginning, I think at the beginning of the session, how I had asked all of my committees with jurisdiction to start doing their due diligence under Act 48, which was the, back in 2011, which actually started Green Mountain Care or our, ah, our, ah, move to that.  And so what I did was, I asked each one of the committees that would have jurisdiction, which were five of those committees, and they were to um look and see what exactly is in Act 48 and can we actually achieve what our goal is?

And if they found things that um, through their, uh, their research and through taking testimony, that could either change this into a direction and put us in a direction that we were going to uh have this Green Mountain Care would be sustainable, then I wanted to hear about it and I thought that’s really what the Senate is doing now. So uh the fact of the matter, uh, I believe there was a statement was, um, regarding the funding, and whether or not I believed that, I think I said that, uh, the $2.2 billion dollar package that’s been put on there right now, I said I do not think that that was sustainable or viable in this, uh, current legislative — uh, Legislature. And I stand by that.

And what it, what I’m talking about in that, and people always take that $2.2 billion dollar figure, and they believe that that’s all new money. And it’s not new money. What it is is partially savings that would be found, uh, by way of not having the premiums, um, by cost savings, and so I stand by the fact is that once we find out what this financing package is, which would also first identify what the product is gonna be, um, if we do not have sufficient — if that money, um, is new money, then there’s gonna be a problem. But if we show, and we’re able to demonstrate that the money in that $2.2 billion is currently already in the system, and that Vermonters are already paying, uh, and on top of that, that we find those costs for any new money that’s — cost savings for any new money that’s coming in, then we’re, we have, I think, ahh, what we envision, all of us envision, that is to make sure that every Vermonter has full access, or access to. uh, uh, to great health care here in the state.

Good God almighty. What a statesman.

The purely cosmetic bipartisanship of Vision To Action Vermont

State Reps. Heidi Scheuermann (R) and Paul Ralston (D), the busy bees behind Vision To Action Vermont, have been busy indeed these days. They’re releasing endorsements almost every day. And, on the surface, it looks to be a fair mix of Republicans and Democrats.

This figures, since V2AVT portrays itself as a nonpartisan, centrist, practical, “rise above party labels and get stuff done” kind of political action committee. If you listen closely, however, you can hear the business-friendly dog whistles a-blowin’. From its launch announcement:

[V2AVT is] a non-partisan organization that will promote, support and elect strong candidates for political office in Vermont who advocate for fiscal responsibility in state spending, and are committed to forming balanced, common-sense public policies that encourage economic prosperity, greater opportunities for Vermont families and businesses, and individual liberties and responsibility.

That’s the entire Dog Whistle Philharmonic in a single sentence: fiscal responsibility, balanced, common-sense, economic prosperity, opportunities, individual liberties and responsibility.

And, despite a thin veneer of bipartisanship, the dog whistles continue to sound throughout V2AVT’s list of endorsements.

As of this writing, V2AVT has endorsed 22 candidates: 11 in the House, 10 in the Senate, plus Lt. Gov. Phil Scott. Overall, they’ve endorsed 13 Republicans, eight Dems, and one Independent.

Okay, leaning rightward, but a respectable number of Democrats, right?

Not so much. There’s a strong trend in V2AVT’s endorsements. The higher the stakes, the more Republicans you get. While the House endorsements are split evenly, 5-5-1, the Senate endorsements include seven Republicans and only three Democrats. And then there’s Phil Scott, the group’s only statewide endorsement.

But beyond the mere numbers, there’s this: most of V2AVT’s Republican candidates are in highly competitive races, while their Democratic candidates are either unopposed or in very safe Democratic territory. 

This is especially true in the Senate, where V2AVT has endorsed all the Republicans’ top challengers except Robert Frenier, who’s challenging incumbent Dem Mark MacDonald in Orange County.

Otherwise, it’s like V2AVT and the VTGOP are using the same playbook. Dustin Degree and Norm McAllister in Franklin County, all three Republicans in Rutland County, Pat McDonald in Washington County. Degree, McDonald, and Rutland’s Brian Collamore are the VTGOP’s top three hopes for Senate gains, but they face uphill battles against formidable candidates: ex-Senator Sara Kittell in Franklin, incumbent P/D Anthony Pollina and incumbent D Ann Cummings in Washington (nobody’s beating Bill Doyle), and Rutland’s WIlliam Tracy Carris, son of longtime Senator Bill Carris.

And who are the Democrats supported by V2AVT? The very safe Jane Kitchel and Dick Sears, plus Sears’ Bennington County running mate Brian Campion. There is only one token Republican candidate on the Benn ballot, and Campion is considered a shoo-in.

Oh, and V2AVT also endorsed safe Republican incumbent Joe Benning.

Now let’s look at the House endorsements.

In Chittenden County, V2AVT is backing incumbent Republican Kurt Wright and Repub newcomer Michael Ly in a two-seat district. Wright is safe; the Repubs have hopes for Ly. And in another two-seat district, Chittenden 9-1, V2AVT is supporting the very safe (and centrist) incumbent Democrat Jim Condon and Republican candidate Joey Purvis, who’s hoping to replace retiring Republican Bob Bouchard.

Chittenden 9-1 is a closely contested district. Condon was the top vote-getter by a mile in 2012; Bouchard barely beat Democrat Curt Taylor; Purvis finished a respectable fourth. This is a seat that the Democrats could take.

Up in the perennial battleground of Franklin County, V2AVT is endorsing 26-year incumbent Dem Kathie Keenan and Republican challenger Corey Parent in a two-seat district. Parent is hoping to snag the seat currently held by Dem Mike McCarthy, who won by a mere 20 votes in 2012.

V2AVT’s favorite Independent is Laura Sibilia, a business-friendly type who’s challenging established Democrat John Moran in Windham-Bennington 1. There’s no Republican on the ballot, but Sibilia’s platform is clearly Republican-leaning.

The group has also endorsed safe Republican incumbent Patti Komline.

As for its Democratic endorsements, Jim Condon and Kathie Keenan are well-established incumbents; Clem Bissonnette is running unopposed has no Republican opponent — his challenge is from the Progressive Party; Cynthia Browning is a famously independent-minded Democrat in a safe Democratic district; and Matt Trieber is unopposed in Windham-3.

Overall, of V2AVT’s eight Democratic endorsements, none are in races closely contested by Republicans. Of its 13 Republican endorsements, seven are in races where the VTGOP hopes to gain ground.

That’s not my idea of nonpartisanship. That’s my idea of advancing the Republican cause.

How pertinent is a candidate’s past? A case study

Update: Some of what I write in this post is not true. The candidate has, in fact, spoken publicly about his past. Please see the following correction for the full story and my apology. 

The other day I got a tip. It was about a candidate for the legislature who had  supposedly been charged in another state with running an investment scam, pled guilty to a reduced charge, and served time in prison. Since his release, he has apparently kept his nose clean. Indeed, he became something of an inmates’ rights activist.

He later moved to Vermont, where he has continued on the straight and narrow. He’s now running for State House. He hasn’t revealed his criminal past, nor has anyone reported it, although it can be found through a simple Google search.

The story is more complicated than the original tip would suggest. And I pondered whether I should let it alone. After all, he seems to have reformed himself, and everyone deserves a second chance.

In the end, after much thought, I decided to write this post. The deciding factors: His offense was a serious one — he was accused of bilking investors of as much as $150,000. This happened relatively recently, roughly ten years ago. He was under court order to repay his victims, and as far as I can tell he has failed to do so. And he has not revealed his troubles; his campaign bio carefully omits any hint of his criminal offense and incarceration, even as it trumpets his advocacy for inmates’ rights.

My conclusion: His offense doesn’t disqualify him from public service, but the voters deserve to know and have the opportunity to make their own judgments. It appears to me that the candidate could tell a powerful and believable story of redemption. But he needs to explain why he deserves the public’s trust.

The candidate in question is Janssen Willhoit, Republican hopeful for the State House in St. Johnsbury. His story:

In June 2004, Willhoit was arrested on charges of “theft by deception.” His victims included the mayor of Stanford, Kentucky. The details:

The investment scam was first reported by Stanford Mayor Eddie Carter, said [Stanford police detective Rick] Edwards. Carter had reportedly invested more than $50,000 of his personal money with Willhoit’s false company, Net City. Net City, which promised investors high interest rates, was supposedly a subsidiary of National City Bank. But when Carter called to check on his account, he was told the number was a phony.

… False investment paperwork had lulled the victims into trusting Net City by indicating the company was a affiliated with Met Life Insurance companies and of legitimate financial protection companies, Securities Investor Protection Corp. and NASD. Officials from the bank and Met Life confirmed that Net City was never an associate during that time, police report.

… Investors’ cash is thought to have been used to support Willhoit’s comfortable lifestyle before his arrest.

In August, Mayor Carter filed a civil suit against Willhoit. He quickly won, and was awarded $55,000 in restitution and damages.

In November 2004, Willhoit agreed to a plea deal that would have let him avoid prison if he repaid his victims. The first step in that process was to post a $10,000 bond, followed by monthly payments of $600.

But in December, he was back in court:

Janssen Willhoit, 25, who swindled approximately $95,000 from three Stanford residents through a phony company, was sentenced to 10 years in prison with the possibility of shock probation.

… Willhoit faced Circuit Judge Robert Gillum without having paid the promised money. Both the judge and Assistant Commonwealth’s Attorney Daryl Day expressed their frustration with the development.

“He doesn’t have the $10,000,” said [defense attorney Mitchell] Berryman. “It leaves us in a quandary.”

“It doesn’t leave me in a quandary,” Gillum said. “I guess he’s going to serve some time then. He’s obviously not going to meet the conditions of probation… He lied to the court.”

In February 2005 Willhoit was back before Judge Gillum to request “shock probation,” which is sometimes granted inmates — usually first-time offenders —  after they’ve been in prison for a short time. The idea is that being behind bars might “shock” a person into changing his ways. But the judge wasn’t buying it. 

Lincoln Circuit Judge Robert Gillum, who handed down Willhoit’s sentence last year, again had stern words for the swindler. Gillum said Willhoit lied to the court in the past by promising to, but not posting, a $10,000 bail to be used as restitution money. Gillum said Willhoit was a flight risk, despite his claims otherwise, and denied the motion.

He was definitely out no later than 2009; in February 2010 he testified before a state legislative committee in favor of a bill to allow former inmates to regain their voting rights. He described himself as a former inmate. (Accompanying image is from the video of his testimony.)

Later that year he moved to Vermont and began studies at Vermont Law School. After graduating, he moved to St. Johnsbury and joined the law firm of Willey & Power.

Earlier this year, Willhoit launched a campaign for State House. In the August primary, he came in second in a three-way race for two Republican nominations, advancing him to the November election.

Willhoit’s campaign bio barely mentions his life before 2010. It does boast of his volunteer efforts after Tropical Storm Irene, his work as a public defender in the Northeast Kingdom, his active membership in a local church, and his work mentoring prisoners.

It also proclaims his commitment “to serving the least among us” without ever mentioning that he used to be one of the least among us.

As I said earlier, I don’t believe that Willhoit’s criminal past or his apparent failure to make restitution should disqualify him from the Legislature. (Insert snide comment about the probity of State House denizens here.) But the people of St. Johnsbury should know about it, and he should fully explain the circumstances of his offense, whether he has repaid his victims, and if not, why not. After that, the voters can make an informed choice.

Early afternoon thoughts on campaign finance filing day

First, a couple newsworthy Tweets from VPR’s Peter Hirschfeld. He reports that the Scott Milne campaign will report roughly $20,000 in contributions, and that Phil Scott will report about $50,000. Milne’s total is awfully pitiful; Scott’s still got a ways to go to catch up with Dean Corren, who qualifies for up to $200,000 in public financing.

As of 1 p.m., neither candidate had actually filed. Other notes:

— The aforementioned Corren reported just under $20,000 in donations from 862 donors. No single donation is worth more than $50. That’s an impressive show of organization and appeal.

— If you want a snapshot of the relative financial pull of the Democrats and Republicans, take a look at their respective House campaign operations. The Dems have raised a daunting $108,000 for their House campaign kitty and spent almost all of that. Notable on the expense ledger are salaries for two campaign staffers — just for the House campaign. (The Repubs, at last check, had one paid staffer for the entire state party. Might be two.) The Republicans’ House campaign operation has raised a paltry $12,000 and spent about 5K.

— Most of the House Dems’ money has come from two sources: State Representatives financially supporting a joint campaign, and corporations and their PACs. Big bucks from MVP Health Care, the Association of Vermont Credit Unions, the Vermont Realtor PAC, New England Cable and Telecommunications Association, and the Corrections Corporation of America (yuck), among others.

— You know which PAC has taken in more money than the Republicans’ House campaign? The Common Sense Leadership PAC, the brainchild of House Minority Leader Don Turner. He’s raised $26,000 for this cycle and spent $12,000. None of it on donations to House candidates. He has paid $2700 to consultant Shayne Spence, and $900 to Johnston Consulting. Why he’s wasting money on Darcie Johnston’s “expertise” only he can say. Turner raised $10,000 of his money in $2000 increments from two stalwart Republican families: the Vallees and the Pizzagallis.

— In the closely-watched State Senate race in Windham County, Joan Bowman has reported donations totaling $1500. But about three-quarters of that is from herself or her family. Bowman is one of four Democrats running for two Senate nominations in August: the others are incumbent Jeanette White, former Douglas Administration cabinet member “Artful” Roger Allbee, and newcomer Becca Balint. It’ll be interesting to see how much Balint takes in; from the outside, it looks like she and Bowman are in a face-off for the non-White, non-Allbee votes.

Bill Doyle doesn’t have to lift a finger, and isn’t. He’s sitting on a balance of $6,500 from previous campaigns. He’s raised $100 this year and spent nothing. I think he’s rightly confident.

Pat McDonald, the former Republican State Rep who’s now running for one of Washington County’s three seats, has racked up a noteworthy $10,000 in donations. She’s spent about half of that.

Doug Hoffer has raised a modest $4400 and spent most of it. Well, he is essentially unopposed in his bid for a second term as Auditor. The bulk of his spending was in two contributions to the state Democratic organization: $1500 to the party, and $2250 to the Dems’ “coordinated campaign.” I guess Doug’s taking this “Prog running as a Prog/Dem” thing seriously.

— Former Republican Representative Oliver Olsen, on the comeback trail as an Independent, is raking in the cash (by House standards). He’s raised $5,700, and spent almost nothing.

— Who hasn’t been a candidate in four years, but keeps on filing campaign finance reports? Matt Dunne, that’s who. He filed as “not a candidate” and reported a carry-over surplus of $2,856.54.

— Former Democratic State Senator Bill Carris, who resigned for health reasons in 2012 (Eldred French was appointed to fill out his term), has liquidated his campaign funds. He had $9400 on hand, and distributed it to a variety of candidates and the state Democratic Party. Notable gifts: $2000 to Senate President Pro Tem John Campbell, $1000 to French’s re-election campaign, and $1800 to his son William Tracy Carris, who’s also running for a Democratic nomination in Rutland County, which has a total of three Senate seats.

— Perhaps the most active of Republican groups so far, at least in terms of supporting candidates, is the Green Mountain Republican Senatorial Committee, which has raised over $15,000 and given healthy start-up contributions of $1500 each to Senator Kevin Mullin and Senate candidate Brian Cullamore, both of Rutland county; and $1,000 apiece to Senator Norm McAllister and Senate hopefuls Dustin Degree, Pat McDonald, Joy Limoge, and Bob Frenier.
