No smoking guns in the Gruber file

Now I know how Neal Goswami’s been spending his spare time lately:

The Vermont Press Bureau obtained nearly 2,400 pages of emails between Jonathan Gruber and state officials that detail the work Jonathan Gruber, an MIT economist, has been doing for the administration.

Woof. That’s a lot of emails to wade through. The result of all that work was published in the Sunday edition of the Mitchell Family Organ. (The article is paywalled; if you don’t subscribe, Get Thee To A Library.)

So what did he find? More impolitic comments about stupid voters and conservative pundits? Arrogant pronouncements over how he’s gonna pull the wool over our eyes?

Er, no.

Emails… highlight the administration’s work since the summer preparing a long-awaited financing plan for Gov. Peter Shumlin’s proposed universal, publicly financed health care plan.

… In a July 7 email to Michael Costa, Shumlin’s deputy director of health reform and the tax expert spearheading the administration’s financing plan, Gruber expressed unbridled enthusiasm at the opportunity to help the state craft a single-payer health care plan.

In short, the emails depict a top-shelf policy expert avidly engaged in a very difficult project, and using his economic model to test countless iterations of single-payer.

And seeing Vermont as a ground-breaking opportunity: “I think we have a chance to make history here,” he said in a July email.

Goswami describes a lengthy, painstaking process that seems to validate Gov. Shumlin’s claims that he couldn’t release his plan because it wasn’t ready yet. This was, the emails show, a long, tough slog. Which still continues; reform chief Robin Lunge expressed confidence that the plan would be ready by late December, but only after an all-out effort.

It’s a fascinating read if you’re a policy wonk. But it doesn’t provide provide any new evidence for legitimate attacks on Gruber or single-payer.

Which is not to say there’s no room for illegitimate, partisan attacks:

“Aha!”, I can almost hear Darcie Johnston crying. “Redacted! Cover-up!”

Partisans will certainly look at it that way. Especially since, according to Goswami, the Shumlin administration had an interesting rationale for adding a provision to Gruber’s contract stating that he “may advise the Governor on policy matters.”

That provision was added, not because Gruber would actually provide any policy advice, but simply to lay the foundation for a claim of executive privilege.

Lunge… said the clause in the contract was included to protect her policy advice to the governor. Gruber has not contributed policy advice to the governor, according to Lunge.

Got that? Lunge generated policy ideas… Gruber ran them through his model… and Lunge used his information to shape her policy ideas. But since she had to give her policy ideas to Gruber, his work must be privileged.

It makes sense, but it also provides fertile ground for conspiracy theories.

And it creates some concerns about government transparency: Lunge told Goswami that “the same provision is also included with other contractors.”

If that’s true, then we ought to be less worried about Jonathan Gruber and single-payer, and more worried about broadening claims of executive privilege.

Shumlin’s Newsdump-a-palooza rolls on

If you regularly read this page, you don’t need to be reminded what a newsdump is. But just in case: it’s the popular maneuver of unloading bad news when the media and the public are least likely to notice. Friday afternoons are the most common times. The final working day before a holiday weekend is ideal.

The Shumlin administration has been making a habit of this lately, and now there are two more newsdumps on the horizon. The first, regarding budget cuts, and the second, Shumlin’s long-awaited big reveal on single-payer health care.

The administration hit a two-fer on the Wednesday before Thanksgiving, ensuring minimal and shallow coverage of its planned $17 million in budget rescissions, and little to no coverage of its plan to make two-thirds of the cuts in Human Services, an agency already said to be underfunded and understaffed.

Shumlin.NewsdumpWell, there’s a sequel to the rescission newsdump. All affected agencies are supposed to submit their proposed cuts by December 5. Hey, what do you know — it’s a Friday!

This should ensure that news about specific cuts will leak out slowly. Or, will perhaps be dumped all at once in a news release issued around 5 p.m. Friday.

It’s also worth noting that the administration gave its agencies less than one business week to make these tough decisions. Its call was issued on Thanksgiving Eve, which meant that the work couldn’t commence in earnest until Monday, December 1.

But wait, you might be thinking. Didn’t the Administration decide not to pursue immediate cuts?

That’s right. Rather than risk a confrontation with the Legislature, it opted to hold off on rescissions until January.

However, the December 5 deadline remains in effect. So state agencies are being rushed into critical budget decisions, even though no action will be taken until more than a month later.

Curious. Methinks the administration might get an early start on those cuts, despite its abnegation of unilateral action.

As for the second newsdump… the Governor announced Wednesday that he would unveil the proposed benefits offered by a single-payer health care system by mid-December, and that his financing plan — the real bone of contention — will come out on December 29 or 30.

What, does he have plans for New Year’s Eve? Or would that be just too damn obvious?

Well, I guess it was too damn obvious anyway. Paul Heintz:

…he swears he’s not trying to bury the news in the lull of the holiday season.

“That’s exactly why I wanted to give you the date now,” Shumlin said during a wide-ranging discussion with reporters at Burlington’s Hotel Vermont. “Because I didn’t want to wake up on December 31 and [read], ‘It was a late-night news dump.'”

So I guess I’m helping out by labeling it a newsdump well before New Year’s Eve Morning. Wouldn’t want to spoil the last cappucino of 2014. (Or maybe I shouldn’t assume he drinks Gucci coffee. Folger’s?)

He claims that he wants to get the plan out early to “get it to the legislators before they’re sworn in.” But the specificity, to use a grand old Watergate word, is a little strange. His team, he says, “is working really hard to get this together.” A task involving that much intensive work with a bunch of people would seem, by its nature, to be somewhat open-ended. And the Governor has particularly avoided deadlines in the health care reform process because so many have been flouted in the past.

And yet he can predict, with certainty, that it will all come together on the 29th or 30th.

Somehow I doubt an extra week or so, including a long holiday weekend, will make a whole lot of difference for lawmakers. If the early release isn’t a newsdump, it will certainly have the effect of one: limiting coverage and blunting immediate reaction to the plan, allowing the Administration to prepare counter-arguments and perhaps even refine the plan before it’s formally submitted.

To me, it looks like a newsdump, walks like a newsdump, and quacks like a newsdump.

Gruber contract officially downsized

One argument the Republicans have made in their desperate effort to fan the flickering flames of Grubermania is that, although Gov. Shumlin cut off Jonathan Gruber’s pay, his contract remained intact and would require a formal rewrite.

Well, mission accomplished, per the Mitchell Family Organ:

State officials released an amended contract with MIT economist Jonathan Gruber Tuesday evening, lowering the maximum amount payable to $280,000.

… Some Republicans had maintained that the original contract required official changes, and said Gruber’s “handshake agreement” with Lawrence Miller, Shumlin’s chief of health care reform, was not sufficient.

The amended contract reflects the change in pay for Gruber.

I’m sure the Republicans will come up with fresh rationales for their obsession. But the contract can no longer be cited as an issue. And if they possess a shred of intellectual honesty, they’ll stop referring to the Gruber contract as a $450,000 deal and adopt the true figure, $280,000.

Ball’s in your court, guys.

Vermont Republicans adopt the Fox News playbook

I don’t know what the hell has happened to Vermont Republicans. With a couple of exceptions (Phil Scott, Kevin Mullin), they seem to have gone batshit crazy.

And crazy in a very particular way. They have taken up the chief weaponry of national Republicans and the Fox News crowd by distilling a complicated issue to a single word.

The issue is health care and the word, of course, is GRUBER!!!!!!

Republicans have not been deterred in the last by Gov. Shumlin’s renegotiation of Gruber’s contract, cutting off further payments to Gruber and thus saving the state $120,000 — some of which will go to independent checking of Gruber’s work.

But it doesn’t matter, at least not to Republicans. They’ve decided “Gruber” is an all-purpose cudgel to attack Shumlin, the Democrats, and the cause of health care reform. Their entire health care focus is on Gruber.

It was only a couple weeks ago that the VTGOP had a big post-election news conference to call for repeal of Vermont Health Connect. We don’t hear that anymore; it’s all Gruber, all the time.

It’s the first time I can remember that virtually every notable Republican and conservative activist seems to be singing from the same hymnal. Kurt Wright sounds just like Rob Roper, and Heidi Scheuermann’s doing her best Darcie Johnston.

This fact hit home for me while reading Rep. Wright’s opinion piece in the Sunday Freeploid. Wright asserts that Gruber’s work on single-payer “will undermine the entire process and debate going forward.” When there’s no evidence that Gruber has done anything more than provide top-flight economic modeling. No matter; as ACORN allegedly poisoned the electoral process and Lois Lerner allegedly proved an Obama conspiracy against the right, the mere presence of Gruber fundamentally undercuts everything about single-payer.

So I guess, by Wright’s logic, we have to throw out all the work that’s been done on single-payer over the last three years and start over? Or is he arguing that by axing Gruber now, when the work is virtually complete, the entire process will be purified as if by cleansing flame?

Wright’s words are identical in meaning to Rob Roper’s. Over at his Koch-funded nonprofit, the Ethan Allen Institute, he claims that Gruber’s entire body of work is useless and cannot be used at all. And Darcie “Hack” Johnston, Tweeting out her policy stances, pronounes Gruber’s work is “tainted” and…

Just watch him, Darcie.

Meanwhile, Sen. Joe Benning is clearly intoxicated by his sudden Fox News fame, referring on his Facebook page to Gruber as “the gift that keeps on giving.” Which sounds disconcertingly like naked political opportunism. He goes on to brag that “FOX wants me back!”

Of course they want you back, Joe: you fit right in with their agenda. And I don’t mean that as a compliment.

On another front, House Republicans have filed a public-records request for Gruber’s work for the state and for communications between Gruber and the Shumlin Administration, I’d applaud them for trying to learn the truth, but given all their public remarks, it seems more like a Darrell Issa-type fishing expedition. What they’re really hoping for is more Gruberisms.

And then there’s the proto-Republicans at Campaign for Vermont, still flogging their online petition calling for Gruber’s firing. Too bad that since Shumlin’s termination of payment, CFV’s petition has pretty much stalled out. As of this writing, it’s at 233 signatures, and it’s been in the low 200s for several days now.

This isn’t about the truth. It’s about using a handful of remarks by Jonathan Gruber to try to undermine the push for single-payer health care.

The weird thing about this is, we just went through an election that provided two object lessons (Phil Scott and Scott Milne) in how Republicans can win in Vermont: by presenting a moderate, inclusive image. Now they’re all foaming at the mouth as though the election never happened and “Angry Jack” Lindley is still running the joint.

They would be well advised to rein in their inflammatory rhetoric lest they alienate the very voters they just managed to attract.

ICYMI, Grubermania hit flood stage today, with the Pitchfork Brigade growing ever louder and — so we hear — Fox News prowling the halls of the Statehouse. (BTW, congrats to Sen. Joe Benning for scoring a primetime Fox appearance out of all this. When life gives you lemons, squirt ’em in your enemy’s eye.)

But the rising waters, laden with political opportunity, almost immediately washed away after Gov. Shumlin dynamited the logjam. Health care reform chief Lawrence Miller:

“…we need solid economic modeling in order to move forward with health care reform. I have told Mr. Gruber that I expect his team to complete the work that we need to provide the legislature and Vermonters with a public health care financing plan. I’ve informed Mr. Gruber that we will not be paying him any further for his part in completing that work.”

A cleverly-worded statement that took a little decoding: Gruber won’t get paid any more for grubering the gruber, but his minions will. And considering that (1) the contract with Vermont expires in three months, (2) the renowned Gruber model is well-entrenched by now, (3) Gruber’s got so many contracts (and so many bigger fish to fry), that Vermont is a drop in his bucket, and (4) I bet the staff’s been doing most of the work anyway… well, I don’t imagine this is much skin off Gruber’s nose.

For Shumlin, it allows the continued use of the Gruber model to finish work on his single-payer plan while also lancing a troublesome political boil. He’s always been at his best in crisis.

We probably should have seen this coming, what with the complete silence from legislative Democrats. Really, did a single Democrat call for Gruber’s firing? I don’t recall any. They must have known that a bacon-saving solution was around the corner.

And what’s that I hear in the distance? Methinks it’s the sound of Fox News’ mobile unit getting outta Montpelier as fast as it can. Nothing to see here, folks.

I’m sure the Republicans will find ways to tend the flame of Grubermania… but from now on, it’ll be more like a votive candle than a bonfire. A votive candile lit in memory of an all-too-brief political opportunity.

Ah, Grubermania, we hardly knew ye.

Phil Scott #2016 rumbles out of Pit Road

In my previous post, I noted a report of some uncharacteristically aggressive remarks by Lt. Gov. Phil Scott. As it happens, Mr. Nice Guy did a brief radio interview this morning on WCVR, “Real Country 1320 AM” in Randolph,”playing all your favorites from yesterday and today!”

Well, maybe not my favorites. I doubt their playlist includes King Crimson or Talking Heads (yesterday) or Arcade Fire or Cold Specks or Godspeed! You Black Emperor (today), but I know what they mean.

Morning deejay Ray Kimball took a few minutes from spinnin’ the tunes to talk with Our Lieutenant Governor. And thanks to Real Country’s livestream, I could listen from my snowed-in central Vermont hilltop redoubt.

I must say, Phil Scott was on his game, combining his customary aw-shucks charm with some well-crafted jabs at the (unnamed) Democrats.

It wasn’t much of an interview, maybe five minutes. And as an interviewer, Ray Kimball is a darn fine deejay. But it gave me a sense that Mr. Nice Guy will be a very dangerous candidate in 2016 if he wants to be. And, for the first time in his career, he’s showing signs that he does indeed want to be. I guess we shouldn’t have doubted the competitive fire of a man whose third profession is auto racing.

Ol’ Ray started by mentioning the expected presence of Fox News, which is apparently nosing around the Statehouse looking for fuel for its festive Jonathan Gruber stake-burning. Initially, Scott didn’t take the bait, instead pivoting to Governor Shumlin’s overdue rollout of a single-payer health care plan. And, in his customarily genial tones, he delivered a fist-in-a-velvet glove shot at Gov. Shumlin.

I’m looking forward to the Governor presenting his plan as he was supposed to do quite some time ago, as was named in the law itself. He’s missed a couple of deadlines. I don’t want there to be any excuses, I want to hear what this financing plan is, what this single-payer looks like, so we can make a decision as to whether it works for Vermont or it doesn’t. And if it doesn’t, I want to move on. The uncertainty it’s created in Vermont just having this discussion, I think has had a negative effect on our economy. So I want to get this over and done, and then move on from there.

Nicely done, sir. Slam the Governor for missing deadlines, assert that the “uncertainty” has hurt Vermont’s economy*, but leave the door open, barely, for consideration of single-payer.

*Please stop with the uncertainty bullshit. Truth is, life itself is uncertain. Businesspeople face far bigger and more pressing uncertainties every damn day. Single-payer, if it happens, is three years away. How much other uncertainty will be packed into those years? 

Ray-Ray then asked a garbled follow-up, and that’s when Scott pivoted back to Jonathan Gruber’s videotaped comments, delivering a skillful punch in his unthreatening way.

His comments were made about Obamacare, but it does bring to light some, ah, you know, you might question some of the tactics and some of the things he’s said, in terms of trying to manipulate the public and perception, so I think some of his, ah, some of his data might be questionable.

Aha. Laying the groundwork for disbelieving the Governor’s plan while maintaining the facade of open-mindedness. He didn’t even call for Gruber’s head on a plate; he just undermined Gruber’s work.

Then Kimball asked about the budget. Scott took that ball and ran with it.

I know we can’t continue to look back, but I look back a few years as, uh, as to when Governor Douglas vetoed the budget…

Let’s stop for a moment and note the contradiction there: we can’t look back, but I’m looking back. Okay, Phil, continue.

… when Governor Douglas vetoed the budget, said it was unsustainable in the future, and it turns out he was right. We, uh, the Legislature overrode his veto and put that into place, and I think that’s where it started. And I think we’re living, ah, beyond our means. We’re spending, we, ah, we’re spending more money than we’re receiving. Revenues are down. So we’ve had to make corrections, and we’re going to have to tighten our belts, and it’s going to take all of us to determine how we’re going to do that, because we can’t spend more than we’re taking in.

Well played! Referring to the halcyon days of Jim Douglas, blaming the Democrats and Gov. Shumlin without naming them, couching harsh criticism in kitchen-table terms, and even calling for bipartisanship while, at the same time, trumpeting Republican orthodoxy. Ingenious.

There have been persistent doubts that Phil Scott has the fire in the belly, that he’d most likely stay within his comfort zone as Mr. Nice Guy, Lieutenant Governor For Life. It’s very early, but I suspect we can lay those doubts to rest.

Phil Scott exits 2014 with over $100,000 in campaign cash, and he’s proven he can be a big-time fundraiser within the humble boundaries of Vermont. If he can mount a credible campaign, and I think it’s clear he can, he’ll start drawing some outside money as well. He is developing a solid message, combining Jim Douglas-style plausible moderation with skillfully coded shout-outs to the True Believers.

If he wants the 2016 gubernatorial nomination, he’ll have it. And he will be the most formidable Republican candidate since Jim Douglas left the scene.

Hell, at this rate, he might turn out to be better than Jim Douglas.

Postscript. This was a brief interview, but a couple of items were notable by their absence. The name “Scott Milne” was not mentioned. And there was no talk of repealing Vermont Health Connect which, if I recall correctly, was the Republicans’ clarion call less than two weeks ago. 

Here’s a pleasant surprise

I didn’t think the Governor had it in him, especially in the wake of his Election Night smackdown. But he’s not giving in to the Pitchfork Brigade’s call for the head of Jonathan Gruber. Neal Goswami of the Mitchell Family Organ:

Vermont Gov. Peter Shumlin said Monday that a state contractor under fire for derisive comments he has made about American voters and a Vermont commentator will not have his state contract terminated despite calls to do so by Republicans.

Jonathan Gruber, a Massachusetts Institute of Technology economist, has a personal services contract with Vermont that will pay him up to $400,000 to test economic models related to Shumlin’s universal, publicly-financed health care proposal, often referred to as a single payer system.

The Governor’s stand does come with strings: He will not exercise an option to extend Gruber’s contract beyond its expiration in Februiary. And he did his best to dump all over the contrator whose economic model is too valuable to do without:

…”for me it’s not just what he said, it’s that he actually thinks this stuff. It’s not the way we do things in Vermont.”

Shumlin was also careful to delineate between Gruber the technocrat and Gruber the policy advisor:

“It’s our plan, not his. It’s our policy, it’s our hope for the future and it’s our plan. We’ve used him as a calculator not a policy advisor,” Shumlin said.

Okay, fair enough. Keep him on, and do what you must to distance yourself from his arrogance. Much better than to give in to the howling mob.

Grubermania: Catch it!

Well, Vermont conservatives finally have a live one: a get-your-blood-boiling, wave-the-bloody-shirt phony “issue” of the kind that rarely presents itself in our green and pleasant land. And boy howdy, are they ever jumping on the outrage train.

Critics of the Shumlin administration are demanding the dismissal of a state consultant whose remarks about the Affordable Care Act last week went viral on Twitter and was picked up by major news outlets…

The target, of course, is Jonathan Gruber, health care expert and creator of the best economic model for health care systems. And utterer of some completely charmless comments on a handful of occasions over the past few years.

Just think, in this age of digital media, how many Young Conservatives are being gainfully employed searching through endless hours of Gruber’s public appearances, trying to locate bits of marketable outrage. Gruber’s been a high-profile figure in health care reform for many years; because of the unique usefulness of his model, he’s been hired by the feds and a whole bunch of states. He’s given testimony, he’s given speeches, he’s been on countless panels.

But never mind the inherent unfairness of tearing a man’s reputation to shreds over a few words. We’ve got some rabble-rousing to do! And our junior-league rabble-rousers are in full force: Rob Roper, Darcie Johnston*, and oh wait — here’s a new entrant to the Pitchfork Brigade: the previously cool-headed, plausibly nonpartisan Campaign for Vermont!

*And again I say, why in hell is anybody listening to Darcie Johnston after the faceplant of the Dan Feliciano campaign added another chapter to her Little Book of Failure?

Between this and CFV moneybags Bruce Lisman’s recent mouth-foamer of an opinion piece (about which more in an upcoming post), it looks like CFV is finally shedding its chrysalis of nonpartisanship and emerging as the Butterfly of Fiscal Conservatism we all suspected was in there all along.

All this Grubermania has a purpose: to toss a can of nails in the Road to Single-Payer, as VTDigger’s Anne Galloway reports:

Gov. Peter Shumlin… is moving ahead with his signature single payer health care initiative. Gruber’s work is crucial to that effort.

“Crucial” because Shumlin has to show that single-payer won’t hurt the state’s economy. Gruber’s model is by far the best tool for the job.

No Gruber, no model. And Shumlin’s task gets a little bit harder.

Now let’s see what kind of cojones the Administration has. WIll they stand by their guy in the face of grossly exaggerated attacks? Or will they toss him off the dogsled in hopes of distracting the wolves?

Based on past experience, I hope Gruber is packin’ a Bowie knife. After all, one of the great saints of Vermont liberalism, Peter Welch, fell for a similar outrage over alleged malfeasance at ACORN. Welch, you may recall, played a small and ignominious role in ACORN’s termination. Sadly, I expect nothing better of Governor Shumlin.

Shumlin: “We have a structural deficit” and other happy tidings

An uncharacteristically subdued Governor Shumlin held an agenda-free news conference this morning. I emphasize “agenda-free” because his past practice has been to piggy-back news conferences onto photo opportunities or policy announcements, leaving much less time for general questions.

Today there were a lot of questions and a lot of substance. In no particular order…

The Vermont Health Connect website will go back online this Saturday, which happens to be the first day of open enrollment. So the relaunch will come on the last possible day. Gee, hope things go right; there’s no margin for error.

Shumlin pronounced himself “optimistic,” saying “I’m encouraged by what I’m hearing.” But given how often he, and we, have been burned in the past, he was reluctant to make any predictions. “I’m always hoping it will work.”

— He dismissed Republican calls to shut down VHC and go with the federal exchange, and he had several good arguments. First of all, it’s far too late to make the change this year, so we’d be limping along with VHC for another year in any case. And there are signs it’s finally getting on track. “We’re turning a corner,” he said. “Why not give it a chance?”

There’s also the fact that the federal exchange’s premium subsidies aren’t as generous as Vermont’s. Switching to the federal system would mean higher premiums for thousands of Vermonters who earn between 100-300% of the poverty line.

And, as he pointed out, the US Supreme Court may well strike down federal subsidies, in which case only states with their own exchanges will be able to offer subsidies.

— Get ready for a slam-bang legislative session. Shumlin is still talking about the next step in health care reform (see below), the legislature is hell-bent on property tax and/or school funding reform, Shumlin is talking about significant changes to energy policy, and perhaps worst of all, the quote atop this post: “We have a structural deficit at this point.” Meaning huge challenges in fashioning a budget. That’s a hell of a lot of big, contentious issues to tackle.

— Speaking of the budget, Shumlin acknowledged that Vermont and many other states “thought the recovery would be more robust,” and its weakness has caused revenue shortfalls. He’s talking about a second round of rescissions in this year’s budget, although he said nothing is final just yet. And he’s talking about major changes in next year’s budget in order to put an end to annual budget crises.

He wants to put the state on a more sustainable path. Which must be making a few Republicans chuckle, since they’ve been preaching this for years. On the other hand, Shumlin has a valid point: the recovery has been weak. If we’d had a normal recovery with decent wage gains, our tax revenue would be stronger and we wouldn’t be facing this dilemma. The big news on this front is that the Governor now believes we’re facing years of sluggishness, and we need to ratchet down the budget to make it sustainable.

When asked whether this might mean tax increases, he didn’t rule them out, but he made it clear that his first choice is to rein in spending.

— On the push for single-payer health care, he repeated his longstanding support for the idea, but acknowledged that in the wake of the election, everything is on the table. He is aiming for a system that combines affordability with universal access to health care. His preference remains single-payer, but it’s looking like we might settle for less than that.

— He made it clear that yes, he won the election, and he has no doubt that he will serve a third term. He pointed to Vermont’s long tradition of electing the top vote-getter when no one wins a majority: ‘The person who gets the most votes, wins.” He cited the 2002 election for Lieutenant Governor, in which he and Progressive Anthony Pollina combined for a liberal majority but Republican Brian Dubie won the most votes; he and Pollina urged lawmakers to elect Dubie, which they did.

— On school funding and organization, he declared “We have a spending problem,” with high per-pupil costs and administrative structures. In some cases, he said, small class sizes can be harmful to achievement rather than helpful. He’s not in favor of mandatory school consolidation, but it’s clear he will push for consolidation by trying to convince local districts that it’s in their best interest.

He did mention the idea of “prioritizing funding to schools that voluntarily consolidate.” That kind of legislative payola may be effective, but it kinda stretches the definition of “voluntary.”

— In a less wide-ranging news conference, his comments on energy policy might have made headlines. They’re likely to get lost in today’s news. He noted the pending sunset of the SPEED program, which has helped spur the renewables industry in Vermont but has also created controversy because it allows the sale of “green” energy credits in other markets. He and the legislature are working on “ideas to replace SPEED.”

He was asked about the prospects for a carbon tax with offsetting cuts in other taxes — a plan likely to be announced tomorrow by a coalition of environmental groups. He was cool to the idea, saying “It’s tough for a small rural state to do it alone,” and pointing particularly to its impact on gas stations near our state borders. He prefers a regional carbon tax instead; but he said he’s had no conversations with other northeastern governors about the idea. Methinks the enviros will have a hard time gaining traction, when you combine Shumlin’s reluctance with an extremely busy legislative session.

— Finally, he was asked about marijuana legalization. He said he wants to wait until the release of a report on the idea in January before proceeding, but noted that “I support legalization. The question is “when.”

Oh boy, oh boy, it’s last-minute dirty tricks time

The Republicans are targeting potentially vulnerable Democratic lawmakers with a mailer repeating the conservative lie that the Shumlin Administration wants to “take over” Medicare.

I’ve seen two mailers, identical except for the specific candidates involved. One is for Addison County Republican hopeful Valerie Mullin, and it targets incumbent Dems Mike Fisher and David Sharpe. The other is on behalf of Republican John Mattison, who’s challenging incumbent Herb Russell of Rutland City.

The Mullin flyer bears the return address of “Friends of Valerie Mullin,” her campaign committee, but it clearly was not produced by her campaign because, as I said, it’s identical to the Mattison flyer.

I’ve only seen these two, but it wouldn’t surprise me if identical mailers hadn’t been sent in all districts where a Republican has a chance to knock off a Democratic lawmaker.

So let’s review. In Act 48, the 2011 health care reform bill, there was a provision calling for the state to pursue administration of Medicare as part of single-payer health care. This provision is what’s called “session law,” and was intended as a guideline rather than a mandate.

“In 2011, we asked the administration to entertain lots of things, but it was in the context of ‘tell us whether you can do this,’” said Rep. Mike Fisher (D-Lincoln), who was on the House Health Care Committee when it drafted Act 48.

Administration officials subsequently discovered that the feds wouldn’t allow Vermont to manage Medicare. It was impossible in any case, because Medicare for the entire Northeast is in a single administrative district. Vermont would have had to take over the entire region, which was clearly out of the question. This year, Act 48 was amended and the provision was dropped.

Which hasn’t stopped the desperate Republicans from repeating the lie. And now they’ve produced mailers trumpeting the lie.
